Uniform food and beverage tax. Creates uniform food and beverage tax authorization provisions for cities and counties that are not required or authorized to impose a food and beverage tax under any other food and beverage tax enabling statute. Specifies the food and beverage tax adoption procedure, maximum food and beverage tax rate, uses of revenue from a food and beverage tax, and the duration of the food and beverage tax.

Prepayment of assessment installments.

Prepayment of assessment installments. Revises a provision of the municipal Barrett Law to: (1) require a municipal works board to establish a policy to permit an owner of real property in the municipality that has filed a waiver to pay the property owner's assessments in deferred installments to prepay the property owner's assessment; and (2) specify that the policy must allow such a property owner to pay the assessment in full at any time, including within the year in which the waiver is filed to pay assessments in deferred installments, while retaining the provision in current law for payment in full at any time after the expiration of the first year after the filing of the waiver.

Positive personal outcomes.

Positive personal outcomes. Includes instruction that stresses the nature and importance of the positive personal and societal outcomes associated with: (1) obtaining a high school diploma or high school equivalency credential; (2) securing full-time employment; and (3) waiting until marriage to begin having children; in existing good citizenship instruction.

Notice of eviction.

Notice of eviction. Requires a landlord to provide notice at least five days before filing an eviction that includes the following: (1) The amount owed. (2) A calculation of late fees. (3) Acceptable methods of payment. (4) The date the landlord intends to file an eviction if charges remain unpaid. Provides methods of written notice. Provides that notice is not required to terminate a lease if the landlord has met other notice requirements. Requires a landlord to complete required repairs issued by an eligible enforcement authority and meet standards required by a county health department. Repeals a provision concerning refusal or neglect to pay rent and corresponding notice requirements.

Labor requirements for data center incentives.

Labor requirements for data center incentives. Requires that an agreement between a qualified data center user or quantum computing research, advanced computing, and defense infrastructure network operator and the Indiana economic development corporation for a specific transaction award certificate includes a requirement that the user or operator limit bids or requests for proposals for the project to labor unions or employers that have project labor agreements.

Eviction task force.

Eviction task force. Establishes the access to counsel in eviction task force (task force) to review matters related to the eviction process and potential funding sources to increase a tenant's access to counsel in an eviction proceeding. Sets forth membership, and requires the task force to issue a report to the legislative council. Provides that the task force expires December 31, 2026.

Shared labor to conduct referendum.

Shared labor to conduct referendum. Provides that a charter school that will participate in an operating referendum tax levy or school safety referendum tax levy must contribute a proportionate share of the labor (in addition to the cost under current law) to conduct the referendum based on the total combined average daily membership of the school corporation and any participating charter schools.

Designated public forums.

Designated public forums. Defines a "designated public forum". Provides that the state or a political subdivision may impose time, place, and manner restrictions on speech in a designated public forum, provided that such restrictions are: (1) justified by a compelling interest of the state or political subdivision; (2) narrowly tailored; (3) administered using the least restrictive means available; and (4) viewpoint neutral. Provides that the state or a political subdivision may not exclude speech: (1) made by a religious or political group, if the speech is consistent with the designated public forum's purpose; or (2) solely because it expresses a religious or political viewpoint.

Medicaid waiver direct care staff compensation.

Medicaid waiver direct care staff compensation. Sets forth requirements for a home and community based services attendant care service Medicaid provider to meet in the use of the state fund share of Medicaid reimbursement for compensation of direct care staff. Requires the provider to submit a cost report annually to verify compliance.

Nutrition supports Medicaid waiver.

Nutrition supports Medicaid waiver. Requires the office of the secretary of family and social services to apply, not later than October 1, 2026, for approval of a Section 1115 Medicaid demonstration waiver or any other Medicaid waiver to provide coverage for nutrition supports for specified individuals.

Utilities matters.

Utilities matters. Allows an electric or gas utility to establish a customer assistance program for qualified residential customers. Requires the approval of the Indiana utility regulatory commission (IURC) before a public utility may sell stock, enter into certain contracts, effect a reorganization, or acquire control of another public utility. Provides that if a public utility requests IURC approval of the sale, assignment, or transfer of the public utility's franchise, works, or system, the IURC shall grant a right of first refusal to: (1) a municipality in which the public utility's works or system is located; or (2) a public charitable trust; for the purchase or acquisition of the public utility's franchise, works, or system. Provides that the IURC may not authorize a public utility that: (1) provides retail electric or natural gas service; and (2) is under the IURC's jurisdiction for the approval of rates and charges (energy utility); to recover through the energy utility's retail rates and charges any direct or indirect costs associated with specified expenses and activities related to lobbying, legislative action, political activities, charitable giving, litigation, investor relations, and other specified activities and expenses. Requires an energy utility, beginning in 2026, to file with the IURC an annual report that includes specified information concerning costs to: (1) the energy utility; or (2) an affiliate of the energy utility; that are related to these expenses or activities and that are directly billed or allocated to the energy utility. Requires the IURC to make available on the IURC's website a direct link to the annual reports provided by all energy utilities under these provisions. Provides that on any customer bill issued by an energy utility after December 31, 2026, the energy utility must include a break down of the charges and fees that make up the total amount owed, including a description of the service or cost associated with each charge or fee. Sets forth certain charges and fees that must be delineated as specific line items on each customer bill.

Electric utility affordability; TDSIC plans.

Electric utility affordability; TDSIC plans. Provides that affordability is the most important attribute of electric utility service that must be considered in decisions concerning Indiana's electric generation resource mix, energy infrastructure, and electric service ratemaking constructs. Provides the following with regard to a public electric or gas utility's transmission, distribution, and storage system improvement charge (TDSIC) plan: (1) The public utility's petition for Indiana utility regulatory commission (IURC) approval of the TDSIC plan must include an executive summary that provides specified information. (2) The public utility and the IURC shall publish the TDSIC plan, and each annual update to the TDSIC plan, on the public utility's and IURC's respective websites. (3) Provides that the public utility shall recover the deferred 20% of the public utility's approved capital expenditures and TDSIC costs under the TDSIC plan only upon the public utility's completion of the eligible transmission, distribution, and storage system improvements included in the TDSIC plan.

Hoosier family leave insurance program.

Hoosier family leave insurance program. Establishes the Hoosier family leave insurance program (program) to provide wage replacement benefits to covered individuals during periods of qualified family leave. Establishes the Hoosier family leave insurance trust fund. Requires the department of workforce development to administer the program.

Hunger-free campus grant program.

Hunger-free campus grant program. Establishes the hunger-free campus grant program (grant program) to provide grants to state educational institutions for purposes of addressing food insecurity among students enrolled in state educational institutions. Provides that the commission for higher education (commission) shall provide a grant under the grant program to a state educational institution if at least one campus is designated by the commission as a hunger-free campus. Establishes criteria that a campus of a state educational institution must meet in order to be designated as a hunger-free campus. Makes an appropriation.

Veterans property tax deduction.

Veterans property tax deduction. Eliminates the assessed value cap that applies to the property tax deduction for a veteran who: (1) has a total disability; or (2) is at least 62 years of age and has at least a 10% disability.

Doula program.

Doula program. Requires the office of the secretary of family and social services to develop and implement a doula program that includes specified components.

Psychiatric care ombudsman.

Psychiatric care ombudsman. Requires: (1) the division of mental health and addiction to establish the psychiatric care ombudsman office (office); and (2) the office of the secretary of family and social services to appoint the psychiatric care ombudsman. Sets forth the powers and duties of the office concerning psychiatric hospitals and patients of psychiatric hospitals. Creates a criminal penalty.

Alkaline hydrolysis for animal remains disposal.

Alkaline hydrolysis for animal remains disposal. Authorizes alkaline hydrolysis as a lawful method of animal remains disposal in Indiana. Requires the state board of animal health to adopt standards for construction, operation, and biosecurity of alkaline hydrolysis. Requires the Indiana department of environmental management to adopt various regulations on alkaline hydrolysis. Defines zoning powers of a local unit regulating the disposal plant performing alkaline hydrolysis.

Decriminalization of marijuana.

Decriminalization of marijuana. Decriminalizes possession of two ounces or less of marijuana.

Family access for youth in detention.

Family access for youth in detention. Establishes minimum standards for resident visitation at a juvenile detention facility or juvenile detention center, subject to certain exceptions.

Arrest power.

Arrest power. Provides that an investigator appointed by a prosecuting attorney has the same police powers within the state if the investigator was previously employed as a law enforcement officer or a federal enforcement officer for at least five years.

Insurance for mental health and substance use. Amends the definition of "treatment of a mental illness or substance abuse" for certain provisions of the Indiana Code.

Lane expansion of I-70.

Lane expansion of I-70. Requires the Indiana department of transportation to take action necessary to construct one or more additional lanes of traffic across Indiana for: (1) eastbound; and (2) westbound; Interstate Highway 70 in areas of Interstate Highway 70 where there are four lanes of traffic. Makes an appropriation.

Epilepsy foundation trust license plate. Establishes the epilepsy foundation trust license plate as a special group recognition license plate. Establishes the epilepsy foundation trust fund.

Report on civics education.

Report on civics education. Requires, not later than October 1, 2026, the department of education to: (1) prepare a report that includes information and recommendations, as applicable, regarding certain civics curriculum, initiatives, and assessments and certain longitudinal methodologies; and (2) submit the report to the general assembly. Establishes requirements regarding the preparation of the report.
