CHATBOT RESPONSE LIABILITY ACT

Creates the Chatbot Response Liability Act. Provides that a proprietor of a chatbot that is used as an alternative to a human representative or that provides any substantive response, information, advice, or action may not disclaim liability if the chatbot provides materially misleading, incorrect, contradictory, or harmful information that results in financial loss or other demonstrable harm or that results in bodily harm to the covered user or any third party. Provides that a proprietor of a chatbot shall provide clear, conspicuous, and explicit notice to covered users that the covered users are interacting with an artificial intelligence chatbot program rather than a human. Sets forth requirements for proprietors of companion chatbots, including parental consent for the use of companion chatbots by minors. Requires the Attorney General to adopt rules to determine commercially reasonable and technically feasible methods for proprietors of companion chatbots to comply with the Act. Effective one year after becoming law.

USE/OCC TX-MODIFIED VEHICLES

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that, beginning on July 1, 2026, the 1% rate of tax on modifications to a motor vehicle for the purpose of rendering the motor vehicle usable by a person with a disability applies to tangible personal property that is installed in or on a motor vehicle before, during, or after the purchase of the motor vehicle for the purpose of rendering the motor vehicle usable by a person with a disability. Provides that the 1% rate of tax on that property applies only if the tangible personal property is separately itemized on the bill or invoice for the sale of the motor vehicle or if the tangible personal property is purchased separately from the motor vehicle and is separately itemized on a bill or invoice. Effective immediately.

INC TAX-FUEL COSTS

Amends the Illinois Income Tax Act. Provides that a taxpayer that incurs qualified infrastructure costs in connection with the sale at a qualified retail motor fuel facility in the State of biodiesel, higher blends of ethanol fuel, and renewable diesel is allowed an income tax credit in an amount equal to 30% of those qualified infrastructure costs. Provides that the credit may not exceed $200,000 per qualified facility and $1,000,000 per taxpayer per taxable year. Effective immediately.

NEW MARKETS-CREDITS

Amends the New Markets Development Program Act. Provides that a credit under the Act may be transferred to an affiliate. Provides that the cap on credits is $37,000,000 for fiscal years beginning on or after July 1, 2029. Makes changes concerning the allocation schedule. Effective immediately.

VEH CD-REG FEES-VETERANS-WAIVE

Amends the Illinois Vehicle Code. Provides that the standard registration fee for passenger motor vehicles of the first division and motor vehicles of the second division weighing not more than 8,000 pounds shall be waived for any veteran who holds proof from the United States Department of Veterans Affairs of a service-connected disability.

PROP TX-SENIOR FREEZE

Provides that, if and only if Senate Bill 642 of the 104th General Assembly becomes law in the form in which it passed both houses on October 31, 2025, then a provision in the Property Tax Code concerning the Low-Income Senior Citizens Assessment Freeze Homestead Exemption is amended by (i) specifying that, for taxable years 2029 and thereafter, the term "maximum income limitation" means the maximum income limitation for the immediately preceding taxable year, multiplied by one plus the percentage increase, if any, in the Consumer Price Index-U for the 12-month period ending in September of the calendar year immediately preceding the taxable year for which the limitation is calculated and (ii) adding a definition of the term "Consumer Price Index-u". Effective upon becoming law or on the date Senate Bill 642 of the 104th General Assembly takes effect, whichever is later.

9-1-1 STATEWIDE SURCHARGES

Amends the Emergency Telephone System Act. Provides that, beginning January 1, 2026, the statewide surcharge shall be $2.50 per connection.

ELEC CD-TOWNSHIP ORGANIZATION

Amends the Election Code. Provides that, in counties under township organization, an election authority may combine a township with another township to constitute one election precinct if the townships are contiguous and 2 or more specified conditions are satisfied. Provides that the election authority shall consider voter convenience and election integrity when determining whether to combine a township with another township to constitute one election precinct.

PROP TX-GENERAL HOMESTEAD

Amends the Property Tax Code. Provides that, for taxable year 2026, the maximum reduction for the general homestead exemption shall be $10,000 in all counties. Provides that, for taxable years 2027 and thereafter, the maximum reduction for the general homestead exemption in all counties shall be the maximum reduction for the immediately preceding taxable year, increased by the lesser of (i) 5% or (ii) the percentage increase in the Consumer Price Index during the 12-month period ending on September 30 of the immediately preceding taxable year. Provides that, for assessment years following the next general assessment after the effective date of the amendatory Act, no increase in assessment may exceed 20% per year, subject to certain exceptions. Amends the Tax Increment Allocation Redevelopment Act of the Illinois Municipal Code. Provides that all surplus funds in the special tax allocation fund shall be distributed as soon as possible after they are calculated (rather than distributed annually within 180 days after the close of the municipality's fiscal year). Effective immediately.

CATCH HEART DISEASE EARLY ACT

Creates the Catch Heart Disease Early Act. Provides that all Illinois residents, 20 years of age or older, are entitled to heart disease screenings at no cost according to the following schedule: one screening every 6 years for individuals aged 20 through 39 years; and one screening every 2 years for individuals aged 40 years and older. Provides that no individual shall be charged any co-payment, co-insurance, deductible, out-of-pocket fee, or other cost-sharing amount or required to enter into any cost-sharing agreement in order to access heart disease screenings. Provides that the State of Illinois shall be the payer of last resort and only cover any outstanding screening costs for eligible uninsured or underinsured individuals whose public or private insurance, including Medicaid or Medicare, does not cover the full cost of heart disease screenings. Provides that service providers of heart disease screenings for eligible uninsured or underinsured Illinois residents shall be reimbursed through a voucher program. Requires the Department of Healthcare and Family Services to perform certain functions to implement the Act, including, but not limited to: (i) establishing a confidential registry to track screening dates and prevent duplicate heart disease screenings outside the authorized frequency; and (ii) provide a mechanism for individuals and providers to verify screening eligibility. Requires health care providers to verify an individual's age, residency, date of last heart disease screening, and other matters prior to administering a screening and recording it in the individual's medical record. Contains provisions on Department rules. Provides that, subject to appropriation, the Department shall implement the voucher program by July 1, 2027. Adds conforming language to the State Employees Group Insurance Act, the Counties Code, the Illinois Municipal Code, the School Code, the Illinois Public Aid Code, and the Illinois Insurance Code. Effective immediately.

PROP TX-POLICE AND FIRE

Amends the Property Tax Code. Provides that property that is used as a qualified residence by a police officer or firefighter with a duty-related disability is exempt from taxation under the Code. Effective immediately.

CD CORR-OPIOID USE DISORDER

Reinserts the provisions of the introduced bill with the following changes. Provides that a committed person who is admitted to a correctional institution or facility while under the medical care of a licensed physician, a licensed physician assistant, or a licensed nurse practitioner and who is taking medication for an opioid use disorder or participating in medication-assisted treatment at the time of admission (deletes pursuant to a valid prescription) as verified by the individual's pharmacy of record, primary care provider, other licensed care provider, or a prescription monitoring or information system, shall have the committed person's medication continued and provided by the Department of Corrections pending an evaluation by a licensed physician, a licensed physician assistant, or a licensed nurse practitioner and subject to the treatment provider's medical judgment. Provides that the Department shall ensure that all persons under its care are assessed for substance use disorder not less than once per calendar year. Provides that no person shall be denied medication for opioid use disorder or participation in medication-assisted treatment based on prior success or failure of any medication-assisted treatment program. Provides that if at any time a committed person screens positive as having or being at risk for an opioid use disorder, is diagnosed with an opioid use disorder, or is exhibiting symptoms of withdrawal from an opioid use disorder, and medications for opioid use disorder or medication-assisted treatment is clinically indicated by a licensed physician, a licensed physician assistant, or a licensed nurse practitioner, then the individual may consent to commence medications for opioid use disorder or, if available, medication-assisted treatment, which shall be provided and funded by the Department with the use of any opioid settlement funds allocated to the Department. Provides that the committed person shall be authorized to receive the medication immediately and for as long as clinically indicated.

DESIGN BUILD PROCUREMENT ACT

Amends the Design-Build Procurement Act. Provides that certain provisions of the Act are inoperative for public institutions of higher education on and after January 1, 2028. Provides that certain provisions of the Act are inoperative for the Department of Central Management Services on and after January 1, 2027. Provides that, on and after January 1, 2028, a public institution on higher education shall not be considered a State construction site under the Act. Removes provisions repealing the Act on January 1, 2027. Effective immediately.

VIDEO GAMING TERMINAL PAYOUTS

Amends the Video Gaming Act. Makes changes to defined terms. Provides that each licensed establishment, licensed truck stop establishment, licensed large truck stop establishment, licensed fraternal establishment, and licensed veterans establishment at which video gaming terminals are available shall have a payout device approved by the Board. Removes provisions requiring a player to turn in the player's ticket to the appropriate person at those establishments. Provides that no cash award for the maximum wager on any individual hand shall exceed the W-2G reporting requirements set by the Internal Revenue Service (instead of $1,199). Requires cash awards to be awarded in denominations rounded to the nearest 5 cent credit.

CD CORR-ELECTRONIC COSTS

Amends the Unified Code of Corrections. Provides that when the Department of Corrections enters into a contract with a tablet vendor to provide committed persons with content-controlled tablets that are equipped with free and fee-based technology services for, but not limited to, accessing scanned mail, making authorized video calls, and viewing movies, books, or other authorized materials, the contract must provide that the tablet vendor shall remit to the Department an amount equal to 10% of the profits derived from any fees collected from the committed persons for the use of the fee-based technology services. Provides that the requirements of the provision shall apply to contracts entered into on or after the effective date of the amendatory Act.

DATA CENTERS-VARIOUS

Amends the Illinois Power Agency Act. Establishes the data center self-direct program to allow for customers taking service under the data center tariff to receive a reduction in the charges collected for the procurement of renewable energy resources. Provides that the reduction in charges available to the customer shall increase based on the energy or capacity value of the new additive clean energy generation's contribution pursuant to the specified requirements. Provides that the Illinois Power Agency may require that participating customers provide annual reports related to facility operation and performance, customer electricity consumption and load profiles, and other information as necessary. Amends the Public Utilities Act. On and after January 1, 2027, requires all data centers operating within the State and discharging water to a wastewater treatment plant to identify likely pollutants in the data center's water discharges to monitor the data center's water discharges for the likely pollutants and to maintain data on the pollutant levels in water discharges. Requires the Environmental Protection Agency to analyze and assess all data center water pollutant discharge level disclosure data. On and after January 1, 2027, requires all data centers operating within the State to maintain water consumption data to submit annual disclosures of the data center's water usage to the Department of Natural Resources. Requires the Department of Natural Resources to make an aggregated and anonymized form of data disclosed to it available on a publicly accessible website. Provides that data centers that fail to comply with any disclosure requirements under the Act may be subject to fines of up to $10,000 per violation. Requires the Department of Natural Resources and the Illinois Commerce Commission to adopt implementing rules. Requires a specified electric utility to, no later than 90 days after the effective date of the amendatory Act, make a filing with the Commission that proposes revenue-neutral tariff changes, which shall present the Commission with an opportunity to suspend the tariffs and consider revenue-neutral tariff changes related to rate design. Amends the Water Use Act of 1983. Makes changes in provisions concerning water conflict resolution and groundwater emergency restrictions. Sets forth requirements for data centers under the Act. Makes other changes. Effective immediately.

MEDICAID-READMISSION DATA

Amends the Medical Assistance Article of the Illinois Public Aid Code. Removes provisions requiring the Department of Healthcare and Family Services to: (i) establish benchmarks for hospitals to measure and align payments to reduce potentially preventable hospital readmissions, inpatient complications, and unnecessary emergency room visits; (ii) publish provider-specific historical readmission data and anticipated potentially preventable targets 60 days prior to the start of the program; and (iii) adopt policies and rates of reimbursement for readmission services and other payments.

CERTIFICATE FREE SALE-FEES

Amends the Illinois Food, Drug and Cosmetic Act. Provides that the Department of Public Health shall charge a fee of $65 (rather than $10) for issuing a certificate of free sale, health certificate, or equivalent to Illinois food, dairy, drug, cosmetic, or medical device manufacturers, processors, packers, or warehousers.

MID-INCOME HOUSING GRANT PILOT

Creates the Illinois Middle-Income Housing Grant Pilot Act. Provides that subject to appropriation for this purpose, the Illinois Housing Development Authority (Authority) shall establish and administer a 3-year Illinois Middle-Income Housing Grant Pilot Program to facilitate housing development in targeted communities across the State of Illinois. Provides that eligible grant applicants shall include developers specifically in any community with an authorized River Edge Redevelopment Zone. Provides that any community within this designation is eligible to apply to support projects within such communities. Permits the Authority to enter into a subcontract agreement with developers with qualified residences. Provides that awards can be used for both redevelopment and new development projects; and that grant proposals may be submitted to the Authority directly to be used as a part of a development agreement with an eligible developer. Contains provisions on rules to implement the pilot program, grant award amounts, project costs limits, and other matters. Creates the Illinois Middle-Income Housing Grant Pilot Program Fund to consist of any moneys appropriated for the pilot program. Amends the State Finance Act by adding the Illinois Middle-Income Housing Grant Pilot Program Fund to the list of State funds.

GOVERNMENTAL ETHICS-LOBBYING

Amends the Illinois Governmental Ethics Act. Prohibits a legislator from engaging in compensated lobbying of the governing body of a municipality, county, or township, or an official thereof, or the executive branch of the State of Illinois, or an official thereof. Effective immediately.

ELEC CD-VOTE CENTERS

Amends the Election Code. Provides that, in addition to required vote centers, election authorities may establish additional vote centers under a specified model. Sets forth provisions concerning the number and location of additional vote centers. Provides that, in jurisdictions where in-precinct counting equipment is used, the election authority shall retabulate the total number of votes cast on 5% of the election day equipment used within the election jurisdiction (rather than votes cast in 5% of precincts within the election jurisdiction). Provides that the precincts and voting devices to be retabulated shall be selected after election day on a random basis by the State Board of Elections so that every device used in early voting and all equipment used on election day in the election jurisdiction has an equal mathematical chance of being selected (rather than providing that every precinct and every device used in early voting shall have an equal mathematical chance of being selected for retabulated).

LOBBYIST-OFFERS/PROMISES

Amends the Lobbyist Registration Act. Provides that a lobbyist or lobbying entity may not promise anything of value to an official, State employee, or a candidate for a State executive or State legislative office for the person's support, action, or inaction for a specific legislative action or executive action, including, but not limited to, campaign contributions, endorsement of candidacy, or any in-kind contributions supporting an official, State employee, or candidate for a State executive or State legislative office. Prohibits a lobbyist or lobbying entity from soliciting an official or State employee to violate similar provisions of the State Officials and Employees Ethics Act. Provides that nothing in the provisions prevents the making or accepting of voluntary contributions otherwise in accordance with law.

FANTASY SPORTS PROTECTION ACT

Creates the Fantasy Sports Consumer Protection Act. Provides that the Illinois Gaming Board may regulate the conduct of fantasy contest operators under the Act. Allows the Board to levy and collect fees, surcharges, civil penalties, and, on adjusted gross fantasy contest receipts imposed under the Act, monthly taxes, and identifies other powers and duties of the Board. Includes restrictions, including requiring licensing, of fantasy contest operators. Includes license requirements and requirements for allowable fantasy contests. Contains provisions relating to denial of a license, independent audits, reporting and investigation of prohibited conduct, taxes, compulsive gambling and voluntary self-exclusion, and supplier diversity goals for fantasy contest operators. Amends the Sports Wagering Act. Excludes fantasy contests from the definition of "sports wagering". Amends the Criminal Code of 2012. Provides that participants in fantasy contest wagering shall not be convicted of the offense of gambling when conducted in accordance with the Fantasy Sports Consumer Protection Act. Excludes any real estate, vehicle, boat, or any other property whatsoever used for the purposes of gambling under the Fantasy Sports Consumer Protection Act from the definition of "gambling place" under the offense of keeping a gambling place. Amends the Illinois Administrative Procedure Act. Grants the Illinois Gaming Board emergency rulemaking authority to implement the Fantasy Sports Consumer Protection Act. Effective immediately.

SR CITIZEN INCOME ELIGIBILITY

Reinserts the provisions of the introduced bill. Provides that for grant years 2027 and 2028, the income eligibility limitation amounts shall be increased by an amount equal to the percentage increase of the cost-of-living adjustment issued by the Social Security Administration. Provides that the Department on Aging shall determine the dates upon which the new adjusted amounts take effect and shall publish the adjusted amounts on its website. Makes other changes.

INC TX-INNOVATION CREDIT

Amends the Illinois Income Tax Act. Provides that a taxpayer shall be allowed an income tax credit in an amount equal to 1.3% of the qualified research expenses made by the taxpayer in Illinois. Provides that the taxpayer is not required to have obtained a research and development credit with respect to his or her federal income taxes to qualify for the Illinois research and development credit.
