MEDICAID-HOSP ACCESS PAYMENTS

Amends the Hospital Provider Funding Article of the Illinois Public Aid Code. In provisions requiring the Department to establish the fixed pool directed payment amounts for specific classes of hospitals listed in the Code, provides that, beginning January 1, 2027, the Department of Healthcare and Family Services shall remove from the list the following hospital classes: (i) hospital inpatient services for public hospitals and (ii) hospital outpatient services for public hospitals. Requires the Department to instead, subject to any necessary federal approval, enter into intergovernmental agreements with the respective governing bodies to ensure continued access for those services in rural areas of the State. Provides that the Department shall reinstate the described hospital classes if federal approval is not received. Effective January 1, 2027.

INC TX-SMALL BUSINESS CREDIT

Amends the Illinois Income Tax Act. Creates a credit for certain small businesses in an amount equal to the lesser of (i) 10% of the property taxes paid by the qualified small business during the taxable year for eligible real property or (ii) $1,500. Effective immediately.

HIGHER ED-FREE FENTANYL TESTS

Amends the Public Higher Education Act. Requires a public institution of higher education to make fentanyl testing strips available free of charge through the student health center, a student wellness office, wellness kiosks, and resident assistant programs. Provides that fentanyl testing strips shall be provided in confidentiality to any enrolled student upon request. Allows a public institution of higher education to offer educational materials addressing drug overdose prevention. Effective July 1, 2026.

PTELL-ABATE-NUCLEAR FACILITY

Amends the Property Tax Extension Limitation Law in the Property Tax Code. Provides that, notwithstanding any other provision of law, beginning in levy year 2026, if a specified taxing district provided a property tax abatement under a specified provision of the Energy Community Reinvestment Act in any levy year occurring before the current levy year and if the taxing district was subject to the Property Tax Extension Limitation Law in the levy year of the abatement, then the district's aggregate extension base for each subsequent levy year after the levy year of the abatement but not earlier than levy year 2026 shall be calculated as through the district's aggregate extension for the levy year in which the abatement was granted included the amount of the abatement. Effective immediately.

FOIA PRIVATE INFO-GENDER

Amends the Freedom of Information Act. In the definition of "private information", includes gender identity, sexual orientation, and gender expression.

INS-CONFIDENTIAL BENEFIT FORMS

Prohibits health insurance issuers from specifying or describing personal sensitive health care information in any explanation of benefits, summary of payments, claims history, or any other communication or record relating to payment or coverage of services or procedures involving sensitive health care information for an insured member other than the insured subscriber, unless the insured member receiving the service or procedure clearly makes a request orally or in writing to not suppress information relating to sensitive health care. Grants the Department of Insurance rulemaking authority. Provides that the Department of Insurance, in collaboration with the Department of Public Health, shall develop and implement a plan to educate health care providers and consumers regarding the rights of insured members and the responsibilities of health insurance issuers to promote compliance with the stated requirements. Amends the State Employees Group Insurance Act of 1971, the Counties Code, the Illinois Municipal Code, the School Code, the Health Maintenance Organization Act, the Limited Health Service Organization Act, the Voluntary Health Services Plans Act, and the Illinois Public Aid Code to establish the same requirements in the provisions of those Acts. Effective one year after becoming law.

SCH CD-RADON TESTING

Amends the School Code. In provisions concerning radon testing, provides that every school building of a school district that is occupied or will be occupied shall be tested by January 1, 2029 and shall be retested every 5 years thereafter for radon (instead of recommending that every occupied school building of a school district be tested every 5 years for radon). Provides that all new schools of a school district shall be built using radon resistant new construction techniques in accordance with the American National Standards Institute/American Association of Radon Scientists and Technologists CC-1000, Soil Gas Control Systems in New Construction of Multifamily, School, Commercial and Mixed-Use Buildings standard or a successor standard (instead of recommending that new schools of a school district be built using radon resistant new construction techniques, as shown in the United States Environmental Protection Agency document, Radon Prevention in the Design and Construction of Schools and Other Large Buildings). Removes a provision allowing a person to perform radon screening tests without a license. Makes changes concerning the exemption. Provides that if radon is found to exceed specified levels, then the school district shall (instead of may) hire a licensed radon professional to perform confirmatory measurements (instead of to perform measurements before any mitigation decisions are made). Sets forth provisions concerning mitigation. Provides that a school district may use life safety funds, if available, for radon testing and mitigation. Preempts home rule powers.

ENTERPRISE ZONE-STAR BONDS

Amends the Illinois Enterprise Zone Act. Provides that, if a municipality has adopted an enterprise zone pursuant to the Act and subsequently establishes a redevelopment project area pursuant to the Tax Increment Allocation Redevelopment Act, the municipality may provide for a partial abatement of taxes for property located within both the enterprise zone and the redevelopment project area. Provides that, if a municipality has established a redevelopment project area pursuant to Tax Increment Allocation Redevelopment Act and subsequently adopts an enterprise zone that includes property within the redevelopment project area, the municipality may provide for a partial abatement of taxes for property located within both the enterprise zone and the redevelopment project area. Amends the Statewide Innovation Development and Economy Act. Provides that certain local hotel taxes are considered local taxes for purposes of the Act.

ATTY GEN-HOA OWNERS

Amends the Common Interest Community Association Act. Authorizes the Attorney General to investigate, make findings, or litigate on behalf of unit owners of common interest community associations whose rights have been violated by the owners' governing board under Illinois law or under the board's governing documents. Amends the Condominium Property Act to make the same changes on behalf of unit owners of condominiums. Authorizes the Attorney General to adopt rules to implement the Act.

BLACK WALL STREET PROGRAM

Creates the Black Wall Street Program Act. Requires the Department of Commerce and Economic Opportunity to create and administer the Black Wall Street Program to provide loans and financial assistance to designated communities for the creation of Black Wall Street Business Districts. Specifies further requirements concerning Program eligibility and the disbursement of loan funds under the Program. Requires each municipality receiving a loan under the Program to establish a municipal investment program by which loan funds are disbursed to qualified African American business entities and persons for the purpose of establishing Black Wall Street Business Districts. Allows for the use of loan funds to invest in, issue, or sell bonds for the purpose of the construction of Black Wall Street Business Districts and all related matters. Requires the Department to compile and make available to the public a database of qualified African American contractors and engineers. Requires the Department to create and administer a Black Wall Street Investment Hub for the purposes of providing specified assistance to African American business entities and persons in establishing Black Wall Street businesses. Provides for the adoption of administrative rules. Creates the Black Wall Street Fund as a special fund in the State treasury for specified purposes. Defines terms. Makes conforming changes.

SCH CD-COMMUNICATE W/ STUDENT

Amends the Chicago School District Article of the School Code. Provides that the Chicago Board of Education shall designate a traceable communication system to be the exclusive means for a district employee or volunteer to communicate electronically with students. Requires the principal of each public school to provide parents written or electronic notification within the first 10 days of the school year of each electronic school notification and communication program designated within the traceable communication system. Prohibits, with exceptions, a district employee or volunteer from communicating electronically with a student: (1) outside of the traceable communication system designated by the Board; or (2) through an unauthorized electronic communication program or application. Sets forth disciplinary actions that may be taken for violating the provisions. Allows a parent to submit written consent to authorize a designated district employee or volunteer who is not a family member to communicate electronically with his or her child outside of the traceable communication system. Includes an exception for family members who are district employees or volunteers. Sets forth reporting requirements. Requires the State Board of Education to develop a complaint form for parents to submit to the Board, the district, or the State Board of Education if a district employee or volunteer violates the provisions. Makes other changes.

ONLINE DEGREE PROGRAM ACT

Creates the Online Degree Pathway Pilot Program Act. Establishes the Online Degree Pathway Pilot Program to provide a single, unified, online bachelor's degree program culminating in a degree conferred by a participating university. Provides that application for admission to the Pathway Program shall begin on March 15, 2027 for the 2027-2028 academic year. Provides that the University of Illinois shall serve as the primary degree-granting institution for the Pathway Program. Provides that a student enrolled in any of grades 9 through 12 in a public or nonpublic school is eligible to enroll in dual enrollment courses at any public community college. Provides that credit earned under the Pathway Program or through dual enrollment shall transfer automatically and apply fully toward a bachelor's degree curriculum. Provides that the Board of Higher Education shall develop statewide articulation maps ensuring full alignment among community college courses and university upper-division courses. Prohibits a public university or State agency from circumventing or attempting to circumvent the Act through certain actions. Requires the Board of Higher Education and the Illinois Community College Board to jointly submit an annual report to the General Assembly. Grants joint rulemaking authority to the Board of Higher Education and the Illinois Community College Board. Repeals the Act 5 years after the effective date of the Act. Contains a severability clause, and makes other changes. Effective immediately.

VEH CD-PERMITS-LOGGING PRODUCT

Amends the Permits Article of the Size, Weight, Load and Permits Chapter of the Illinois Vehicle Code. Allows the Department of Transportation and local authorities, with respect to highways under their respective jurisdictions, in their discretion and upon application in writing, to issue a special permit for limited continuous operation, authorizing the applicant to move loads of logging products on a specified vehicles. Provides that the fees for special permits for increased axle loads to be used for hauling logging products is $5 per axle.

STRENGTHENING FATHERS&FAMILIES

Creates the Commission on Strengthening Fathers and Families Act. Provides that the purpose of the Act is to promote the recognition of the importance of the participation of both parents in the lives of their children. Creates the Strengthening Fathers and Families Initiative (Initiative) with the goal of increasing the awareness of the problems created when a child grows up without the presence and support of a caring and loving father, identifying strategies that are successful in overcoming identified obstacles that discourage the active engagement of fathers, and other specified goals. Requires the Initiative to also promote positive interactions between fathers and their children, while promoting positive interactions between fathers and the mothers of their children. Creates the Commission on Strengthening Fathers and Families to carry out the purposes, goals, and initiatives of the Act. Contains provisions on the Commission's membership, goals, and duties, including, but not limited to, (i) developing a comprehensive plan that promotes the positive involvement and engagement of fathers and that advances family strengthening strategies, (ii) evaluating State programs, governmental policies, and community initiatives related to fatherhood and family strengthening, (iii) making recommendations to the Governor, the Deputy Governor of Health and Human Services, and the General Assembly, (iv) developing criteria for grants to fatherhood and family strengthening projects, and (v) receiving grants, contributions, and other funds for projects and activities related to advancing father involvement and engagement, and family strengthening. Provides that the Department of Human Services shall provide staffing support to the Commission. Creates the Fatherhood and Family Strengthening Fund to hold grants, contributions, and other funds received by the Commission to be expended for the purposes of the Act. Amends the State Finance Act to add the Fatherhood and Family Strengthening Fund to the list of State funds.

PROP TX-OMITTED PROPERTY

Amends the Property Tax Code. In counties with fewer than 3,000,000 inhabitants, provides that property that receives an erroneous homestead exemption for the current assessment year or for any of the 3 prior assessment years may be considered omitted property. Provides for penalties and interest to be imposed on that omitted property. Provides that any arrearage of taxes or interest that might have been assessed against that omitted property shall not be chargeable to certain bona fide purchasers of the property. Effective immediately.

SCH CD-REQUIRE CAREER/TECH ED

Amends the School Code. Requires students in the public schools in grades 6 through 12 to receive instruction in career and technical education, which may be satisfied by attending a field trip to a local career and technical education training center. Allows a school board to include the required instruction in the courses of study regularly taught in the public schools, provided that the instruction is given each year to all pupils in grades 6 through 12. Provides that each school board shall determine the minimum amount of instructional time required.

HEALTH CARE WORKER PLATFORM

Creates the Health Care Worker Platform Act. Sets forth provisions requiring any person, corporation, partnership, or association that operates or offers an electronic platform, system, or application through which health care workers can accept one or more shifts to perform health care related services at a health care facility to register with the Department of Public Health prior to operating in the State. Requires the Department to review and issue a decision on each new application or application for renewal of a registration within 30 days after the submission of the new application or application for renewal. Provides that the Department shall allow an appeal of any decision not to approve an application or an application for renewal for registration under the Act. Establishes recordkeeping and operational requirements for a health care worker platform. Effective immediately.

LOC GOV OFFICER'S SALARY

Amends the Property Tax Code. Provides that, elected and appointed supervisors of assessments who began a term of office on or after December 1, 2026, shall be paid a salary in an amount equal to 80% of the amount paid to the State's Attorney of the county that employs the elected or appointed supervisor of assessments. Amends the Counties Code and the Clerks of Courts Act. Provides that, beginning December 1, 2026, the compensation of a coroner, a county treasurer, a county clerk, a recorder, an auditor, or a clerk of a circuit court shall be equal to 80% of the amount paid to the State's Attorney of the coroner's, county treasurer's, county clerk's, recorder's, or auditor' s county. Provides that, the State must pay 66 2/3% of each officer's annual salary. Provides that, beginning with fiscal year ending on June 30, 2027, the county clerk, recorder, auditor, coroner, and treasurer of each county, and the chief clerk of each county board of election commissioners, shall receive a stipend in the amount of $12,800, adjusted annually.

REVENUE-STATE PROPERTY

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Provides that the Department of Revenue shall reimburse eligible municipalities for revenue loss associated with tax exempt State property located in the municipality. Provides that the aggregate amount of reimbursements for all taxing districts in any calendar year may not exceed $100,000,000. Sets forth the amount of the reimbursement. Effective immediately.

IDOR-VETERANS

Amends the Department of Revenue Law of the Civil Administrative Code of Illinois. Requires eligible school districts to report to the Department of Revenue (i) the total amount of veterans' homestead exemptions granted for the 2024 levy year for property located in the eligible school district and (ii) the total amount of veterans' homestead exemptions granted for the current levy year for property located in the eligible school district. Provides that the Department shall certify the difference, if any, between the current levy year exemption amount and the levy year 2024 exemption amount for each eligible school district. Provides that those amounts shall be transferred from the General Revenue Fund to the Support our Veterans and Neighbors Fund. Provides that an "eligible school district" is a school district that contains residential property that is located within 45 miles of a United States military base. Creates the Support our Veterans and Neighbors Fund. Provides that moneys in the Support our Veterans and Neighbors Fund shall be used to make grants to eligible school districts.

MENTAL HLTH-COURT JURISDICTION

Amends the Mental Health and Developmental Disabilities Code. Provides that the circuit court has jurisdiction over persons who are: (1) subject to involuntary admission on an inpatient basis; or (2) in need of treatment by psychotropic medication and electroconvulsive therapy. Provides that no respondent who has pending felony charges may be ordered to undergo a program of hospitalization in a mental health facility operated by the Department of Human Services unless the Department agrees to the program of hospitalization. Removes provisions granting the circuit court jurisdiction, until January 1, 2030, over all persons subject to involuntary admission on an outpatient basis.

CONSERVATION-OPEN SPACE FUND

Amends the Open Space Lands Acquisition and Development Act. Provides that, notwithstanding any other provision of law, moneys in the Open Space Lands Acquisition and Development Fund may not be appropriated, assigned, or transferred to another State fund. Effective immediately.

PROP TX-VETERANS

Amends the Property Tax Code. In provisions concerning the homestead exemption for veterans with disabilities and veterans of World War II, provides that the term "veteran" also includes veterans who were killed in the line of duty but were not Illinois residents at the time of their death. Provides that a requirement that a surviving spouse must be a resident of Illinois from the time of the veteran's death through the taxable year for which the homestead exemption for veterans with disabilities is sought does not apply if the veteran was killed in the line of duty. Effective immediately.

STATE FINANCE-AUDIT FUND

Amends the State Finance Act. Provides that, within 30 days after July 1, 2026, or as soon thereafter as practical, specified sums shall be transferred from various named funds into the Audit Expense Fund. Effective immediately.

WILDLIFE-TRAP MEASUREMENT

Amends the Wildlife Code. In a provision concerning trapping, replaces references to "leghold" with "foothold". Provides that the diameter of traps shall be measured from the inside edges of the outer most portion of the jaws of the trap. Effective immediately.
