Illinois HB4856, the New Child Bonding Leave Act, provides employees who have gained custody of a child within the previous four weeks with up to 12 weeks of unpaid leave. This leave is available regardless of whether the employee has exhausted their Family and Medical Leave Act (FMLA) leave. Employers cannot require employees to use paid leave instead of the leave provided by this Act. Employees must be reinstated to their former position or a substantially equivalent one upon the conclusion of leave, with no loss of benefits.
