Medical Freedom

Citing this act as the "Medical Freedom Act"; repealing a provison relating to the future repeal of the definition of the term "messenger ribonucleic acid vaccine"; prohibiting a vaccine manufacturer from offering or paying, and a health care practitioner from receiving, specified financial incentives for the administration of a vaccine; requiring certain health care practitioners and paramedics to, before administering one or more vaccines to a minor child, provide the parent or legal guardian with specified materials; providing that specified amendments made by the act to s. 456.0575, F.S., take effect on a specified date or within a specified timeframe after the Board of Medicine and the Board of Osteopathic Medicine adopt certain materials by joint rule, whichever occurs later, etc.

Artificial Intelligence Bill of Rights

Prohibiting a governmental entity from extending or renewing a contract with specified entities, beginning on a specified date; prohibiting a local governmental entity from taking certain actions relating to contracting with an entity to provide artificial intelligence technology, software, or products unless certain requirements are met, beginning on a specified date; prohibiting a governmental entity from entering into a contract with an entity for artificial intelligence technology, software, or products under certain circumstances; requiring companion chatbot platforms to prohibit a minor from becoming or being an account holder unless the minor's parent or guardian consents; requiring bot operators to periodically provide a certain notification to a user, etc.

Public Records/Investigations by the Department of Legal Affairs

Providing an exemption from public records requirements for information held by the Department of Legal Affairs relating to notifications or investigations of certain companion chatbot violations; providing an exemption from public records requirements for information held by the department relating to notifications or investigations of certain bot-related consumer protection violations; requiring that certain information remain confidential and exempt upon the completion or cessation of an investigation; providing for future legislative review and repeal of the exemption; providing a statement of public necessity, etc.

State Reapportionment

Proposes amendment to State Constitution to revise reapportionment methods and revise upward the number of Senate and House districts.

Continuous Glucose Monitors

Requires AHCA to, within specified timeframe, seek federal approval as needed to provide coverage of continuous glucose monitors & related supplies as durable medical equipment benefit under Medicaid program; provides for reimbursement of such equipment; provides construction; requires agency to implement these changes upon receiving any necessary federal approval.

Repetitive Head Impact Prevention

Requires parents and legal guardians registering child in high-risk sport to receive specified educational materials; provides requirements for such materials; requires certain athletic directors, coaches, referees, & trainers of high-risk sports to complete specified training; requires State Surgeon General, in collaboration with others, to develop specified continuing education courses for certain persons; establishes Florida Brain Health in Sports Panel within DOH; provides requirements for panel; authorizes department to use certain funds for certain purposes; provides rulemaking authority to department; designates Parkman-Lewis Day.

Career and Academic Planning for Middle and High School Students

Requiring district school boards annually to provide students and their parents with certain information relating to career and technical education programs beginning in a specified grade; requiring middle schools to hold a career and academic planning meeting for specified students and their parents; revising the information included in a student's personalized academic and career plan, etc.

Surrogacy and Assisted Reproduction

Provides & revises requirements for preplanned adoption agreements, surrogacy contracts, & informed consent; requires security background investigations of specified parties; requires donor banks, fertility clinics, & surrogacy agencies to be licensed or certified; requires certain entities & persons to develop best practice policies & submit such policies to specified entity; requires specified material be labeled & records maintained for specified timeframe; requires AHCA & DCF to conduct annual inspections; provides for administrative penalties & corrective action plans; requires certain parties undergo mental & medical evaluations; requires surrogacy agencies maintain escrow accounts & provides requirements for such accounts & escrow agents; requires DCF maintain list of certified surrogacy agencies; authorizes certain parties to petition court to validate surrogacy contract & for expedited affirmation of parental status; authorizes deletion of certain names from certain court documents; requires certain notice; provides requirements if court denies affirmation of parentage; requires AHCA, DOH, & DCF to adopt rules.

Schools of Hope

Authorizes mutual management plans for school district facilities used by schools of hope to include provision for school of hope & school district to share specified costs.

State Reapportionment

Proposes amendment to State Constitution to revise reapportionment methods and revise upward the number of Senate and House districts.

Endangered or Threatened Marine Animals

Prohibits collection & transportation of endangered or threatened marine animals from state waters; prohibits FWCC from issuing, renewing, or approving certain licenses.

Assessment of Inherited Homestead Property

Proposes State Constitutional amendment authorizing Legislature to provide that transfer of homestead property by inheritance is not considered change of ownership for purposes of homestead property assessment.

Golf Course Best Management Practices Certification

Provides legislative findings & intent regarding golf course best management practices certification; provides for type two transfer of Golf Course Best Management Practices Certification program in DEP to DACS.

Transportation Concurrency

Revising which facilities are required to be identified in the capital improvements element of a comprehensive plan that imposes transportation concurrency for small counties, etc.

Outsourcing Facilities

Requires outsourcing facilities apply to DOH, using form prescribed by Board of Pharmacy, to obtain permit before engaging in specified activities; requires department to issue outsourcing facility permits to applicants board certifies as meeting certain criteria; requires that initial application for permit include specified documentation; requires board to review such documentation & consider certain actions of applicant outsourcing facility; prohibits department from issuing permit to outsourcing facility; provides that certain outsourcing facilities are only required to obtain outsourcing facility permit; requires outsourcing facilities to obtain additional applicable permits if they engage in certain activities; provides applicability; provides that outsourcing facilities holding valid outsourcing permit issued before specified date are deemed to be in compliance with certain permitting requirements; authorizes such facilities to continue operating under such permit until certain condition occurs; requires board & department to rely on & recognize certain federal inspection reports as satisfying state inspection requirements for purposes of initial permitting & subsequent renewals; authorizes department to conduct inspections; provides that board is sole state regulatory authority responsible for permitting, oversight, & discipline of outsourcing facilities; exempts permitted outsourcing facilities from separate licensure or permitting requirements under Florida Drug & Cosmetic Act for engaging in specified activities; requires board to adopt rules; exempts permitted outsourcing facilities from applicability of Florida Drug & Cosmetic Act.

Interpersonal Violence Injunctions

Revises provisions relating to interpersonal violence injunctions, including, revising required forms, motions, & information all clerk of court offices must provide to assist petitioners, distinguishing between ex parte reviews & final hearings, requiring personal service & authorizing subsequent service by e-mail, revising service requirements, revising notice & service requirements, revising factors court is required to consider & evaluate, revising what clerk must transmit to sheriff or law enforcement agency, revising service requirements, revising circumstances in which clerk must provide; revises name of Domestic & Repeat Violence Injunction Statewide Verification System created within FDLE to Statewide Injunction Verification System; revises injunctions required to be maintained in system.

Safety Design Standards for Office Surgery Suites

Requiring the Florida Building Commission and the State Fire Marshal, within their respective codes, to establish safety design standards for certain office surgery suites by a specified date, etc.

Educator Certifications and Training

Revises core curricula for certain teacher preparation programs to include training relating to mass casualty incidents; requires certain postsecondary educator preparation institution programs to include training relating to mass casualty incidents; revises certified educator eligibility criteria to require such persons to receive training in mass casualty incidents; requires persons who hold adjunct teaching certificates to receive training in mass casualty incidents.

Grandparent Visitation Rights

Authorizes grandparent of minor child to petition court for court-ordered visitation with child in certain circumstances; making technical changes.

Prohibition on Levying Ad Valorem Taxes on Tangible Personal Property

Conforms provisions to proposed amendments made to State Constitution which prohibit levying ad valorem taxes on tangible personal property by counties, school districts, & municipalities; removes provisions relating to property appraiser's assessments & effect of determinations by value adjustment boards; repeals provisions relating to extending date for filing tangible personal property tax returns; repeals provisions relating to erroneous returns & estimates of assessment when no return is filed; repeals provisions relating to tax returns to show all exemptions & claims; repeals provisions relating to exemption of renewable energy source devices; repeals provisions relating to exemption for tangible personal property; repeals provisions relating to uncollectible personal property taxes & correction of tax roll; repeals provisions relating to attachment of tangible personal property in case of removal; provides transitional provision.

Medical Review Committees

Revising the definition of the term "medical review committee", etc.

Tourist Development Tax Uses

Authorizing a county to use tourist development tax revenues to fund certain commuter rail service operations, etc.

Disability Provisions for Firefighters and Law Enforcement and Correctional Officers

Defining the terms "employing agency" and "heart disease"; providing that a certain previously conducted physical examination satisfies a requirement for a presumption; authorizing law enforcement officers, correctional officers, and correctional probation officers, under a specified condition, to use a physical examination from a former employer for the purpose of claiming a specified presumption, etc.

Protective Injunctions and Protection Orders

Requiring a respondent to surrender to the local law enforcement agency all firearms, ammunition, and licenses to carry a concealed weapon or firearm after the issuance of a final judgment on an injunction for protection against domestic violence; providing for return of firearms, ammunition, and licenses to carry a concealed weapon or firearm when a protective injunction is vacated, terminated, or otherwise rendered no longer effective; revising the criminal penalty for a second or subsequent violation of an injunction for protection against domestic violence or a foreign protection order, etc.

Public Records/Municipal Clerks and their Staff

Providing a public records exemption for personal identifying and location information of current and former municipal clerks and their staff and the personal identifying and location information of the spouses and children of such municipal clerks and their staff; providing for future legislative review and repeal of the exemption; providing for retroactive application of the exemption; providing a statement of public necessity, etc.
