Bills
Amends the Video Gaming Act. Provides that an applicant or licensee is not in violation of the Act or any of the Illinois Gaming Board rules, and shall not be subject to disciplinary action, delay of any Board consideration, or denial of any license for operating a game device if operation of the gaming device is in compliance with and not considered gambling under the Criminal Code of 2012. Amends the Criminal Code of 2012. Provides that a gambling offense involving a specific gambling device is a Class 4 felony. Prohibits a municipality from imposing any restriction or prohibition related to an activity which is lawful under under a provision that set forth activities that a person may not be convicted of gambling for participating. Includes specified vending or other electronic machines or devices in the definition of gambling device. Amends the Prizes and Gifts Act. Provides that it is unlawful for a person to operate on any premises a prize and gift kiosk that fails to meet the specified technical standards. Prohibits a prize and gift kiosk from being connected directly or indirectly to the Internet in order to participate in the game or contest or to receive or retrieve any data related to the kiosk or device unless the connected device is a redemption vault. Provides that is unlawful for a prize and gift kiosk to offer the sale of anything other than a bona fide product. Provides that it is unlawful to operate a prize and gift kiosk without a self contained fill system which permits the operation of the device solely determined on a fee basis or the amount of revenue generated but does not include a system based on time, number of spins or spin equivalent, or other non-revenue based system, and automatically ceases to operate upon the completion of a predetermined cycle. Provides that it is unlawful to operate a prize and gift kiosk without a route boost plus internal monitoring system that accounts and records (i) cash in, (ii) winnings, (iii) entries used, (iv) power failures, disconnections from the monitoring system, and malfunctions, and (v) remote activations and disabling. Requires a prize and gift kiosk to be registered with the Department of Revenue and to remit the annual fee as set by the Department of Revenue. Effective immediately.

Provides that the Business Enterprise Program shall (currently, may) establish uniform standards for calculating contract specific Business Enterprise Program goals for all State contracts and State construction contracts subject to the Act. Removes language providing that the dollar amount of certain contracts is defined by the Secretary of the Business Enterprise Council for Minorities, Women, and Persons with Disabilities and approved by the Council. Provides that the Business Enterprise Council for Minorities, Women, and Persons with Disabilities may permit, on its own initiative, an entire class of contracts to be exempt from State contracting goals for businesses owned by minorities, women, and persons with disabilities if there has been a written determination that there is an insufficient number of qualified businesses owned by minorities, women, and persons with disabilities to ensure adequate competition and an expectation of reasonable prices on bids or proposals within the class. Makes changes concerning deficiencies in utilization plans that may be cured.

Amends the School Code. Allows the school board of a school district to use an adopted and verified program for e-learning days district-wide that permits student instruction to be received electronically while students are not physically present on an election day because a school was selected to be a polling place (rather than adopt a research-based program for e-learning days district-wide that shall permit student instruction to be received electronically while students are not physically present because a school was selected to be a polling place). Provides that e-learning days used for this purpose may not be counted in lieu of the district's scheduled emergency days.
Amends the School Code. Creates the State Employee Child Care Pilot Program Task Force Act. Establishes the State Employee Child Care Pilot Program Task Force within the Department of Early Childhood to evaluate the feasibility of establishing an on-site child care pilot program for State employees; develop recommendations regarding pilot program structure, staffing models, and operational oversight; identify potential State-owned or leased facilities suitable for pilot program locations; and other specified duties. Contains provisions concerning Task Force membership and meetings. Requires the Task Force to submit a report to the General Assembly and the Governor that includes findings, recommendations, estimated costs, and any proposed statutory or administrative changes necessary to implement a pilot program. Provides that the Task Force is dissolved and the Act is repealed on December 31, 2027. Effective immediately.

Provides that each taxpayer that makes a donation to an educational improvement organization for aviation during the taxable year may apply to the Department of Commerce and Economic Opportunity for an income tax credit in an amount not to exceed the amount of the taxpayer's donation that is used to provide scholarships for prospective pilots, airline and aerospace mechanics, and other aviation and aerospace professionals as part of a program that operates in this State. Requires educational improvement organizations for aviation to apply to the Department of Commerce and Economic Opportunity to be eligible to accept donations that qualify for the credit. Provides that the Department of Commerce and Economic Opportunity may award no more than $5,000,000 in credits under the program in any calendar year. Effective immediately.

Establishes certain consumer rights relating to personal data, including the rights to confirm whether data is being processed, to correct any inaccuracies in the consumer's personal data, to delete personal data provided by the consumer, to obtain a copy of the consumer's personal data that was previously provided, and to opt out of targeted advertising, the sale of data, or profiling of the consumer. Defines terms. Applies to persons who conduct business in Illinois or produce products or services that are targeted to Illinois residents and that during a calendar year control or process personal data of at least 100,000 consumers or 25,0000 consumers and derive over 50% of gross revenue from the sale of personal data. Creates requirements for persons or entities that control and process consumer data. Exempts certain persons or entities from the provisions of the Act. Provides that the Attorney General has exclusive authority to enforce the consumer data privacy rights. Creates the Consumer Privacy Fund to be administered by the Office of the Attorney General. Amends the Freedom of Information Act. Exempts from disclosure data protection impact assessments created under the Illinois Consumer Data Privacy Act. Makes a conforming change in the State Finance Act.

Provides that, no later than July 1, 2027, the State Board of Elections shall publish guidelines for compliance with standardization conventions for data fields related to election districts, precincts, polling places, and other election data. Provides for periodic audits of the election data subject to the standardized reporting protocols. Provides that, beginning with the 2028 general primary election, no less than 75 days before each election, every election authority shall ensure that all data reported by the election authority conforms to the data standardization requirements adopted by the Board.

Provides that to ensure Illinois parents with children, including foster parents and parents of adult children with intellectual or developmental disabilities, can easily access all publicly available information on State resources for parents, as soon as practicable the Department shall maintain a publicly accessible webpage on its official website that lists each child care, early child care, education, nutrition, mental health, housing, family planning, cash assistance, health care, and any other program or service for parents operated by the Department or another State agency, including, but not limited to, the Department of Healthcare and Family Services, the Department of Children and Family Services, the Department of Early Childhood, the Department of Public Health, the Illinois State Board of Education, the Illinois Student Assistance Commission, and the Illinois Department of Juvenile Justice. Provides that the webpage must include for each listed program and service a hyperlink to a publicly viewable webpage that is operated and maintained by the State agency responsible for administering the program or service and that includes additional information and resources on the specific program or service.

Provides that the following entities may apply for grants under the Act: (i) units of local government; (ii) soil and water conservation districts; (iii) area-wide agencies, including counties, regional planning agencies, or both; (iv) nonprofit organizations; (iv) public or private institutes of higher education; (v) port authorities; and (vi) federally recognized tribes. Provides that the Department shall issue grants if (i) the requested grant complies with the purpose for which the Department was to provide funds and is subject to the requirements of all applicable court orders and (ii) the grant complies with the criteria established by administrative rule for the issuance of the grant. Provides that grants shall not be awarded to a grantee that is responsible for the pollution event that is the subject or basis for the issuance of the grant. Effective July 1, 2027.

Requires the Medicaid Technical Assistance Center to collaborate with public and private partners throughout the State to identify, establish, and maintain best practices necessary for health providers to ensure their capacity to participate in the Illinois Medical Assistance Program (rather than ensure their capacity to participate in HealthChoice Illinois or YouthCare). Requires the Medicaid Technical Assistance Center to promote equitable delivery systems, remaining committed to the principle that all Medicaid recipients have accessible and equitable physical and mental health care services. Removes provisions concerning the Medicaid Technical Assistance Center's administration of network adequacy reports, and instead requires the Medicaid Technical Assistance Center to administer a network requirement plan. Provides that by using reports and data provided by the Department of Healthcare and Family Service's External Quality Review Organization on network adequacy, provider service deserts, and health care disparities by race and ethnicity, the Medicaid Technical Assistance Center shall propose for Department review and approval an annual plan for recruiting providers to participate in the Illinois Medical Assistance Program and report on outcomes of its recruitment efforts to the Department for continuous improvement. Repeals a provision requiring the Department to maximize federal financial participation for any moneys appropriated to the Department for the Medicaid Technical Assistance Center and to deposit all federal financial participation funds into the Medicaid Technical Assistance Center Fund. Repeals a provision creating the Medicaid Technical Assistance Center Fund. Amends the State Finance Act. Provides for the dissolution of the Medicaid Technical Assistance Center Fund on July 1, 2026, or as soon thereafter as practical, after the transfer of all remaining funds into the Healthcare Provider Relief Fund. Provides that the Act may be referred to as the Mental Health Parity for All Act. Amends the Department of Human Services Act. Provides that subject to appropriations, the Department of Human Services shall establish and administer a program that provides grants to community-based organizations to develop and establish mental health wellness hubs in communities disproportionately impacted by the closure of mental health clinics, hospitals, and schools. Provides that the goal of the program is to provide immediate and accessible behavioral health services and supports to individuals experiencing a mental health crisis or distress prior to the need for psychiatric hospitalization. Requires program grants to be awarded to community-based organizations with a demonstrable history of providing behavioral health services and supports to persons experiencing mental health-related stress. Requires the mental health wellness hubs to provide an array of services aimed at promoting emotional and psychological well-being, including, but not limited to: (1) crisis prevention and intervention; (2) psychiatric assessments and evaluations; (3) individual and group therapy; (4) medication monitoring; (5) nutrition education; and (6) referrals to community resources. Requires the services to be tailored to the community's needs and to be available year-round on a walk-in basis or by appointment to community members regardless of age or insurance coverage. Permits the Department to adopt any rules necessary to implement the program.

Provides that subject to appropriations, the Department of Human Services shall establish and administer a program that provides grants to community-based organizations to develop and establish mental health wellness hubs in communities disproportionately impacted by the closure of mental health clinics, hospitals, and schools. Provides that the goal of the program is to provide immediate and accessible behavioral health services and supports to individuals experiencing a mental health crisis or distress prior to the need for psychiatric hospitalization. Requires program grants to be awarded to community-based organizations with a demonstrable history of providing behavioral health services and supports to persons experiencing mental health-related stress. Requires the mental health wellness hubs to provide an array of services aimed at promoting emotional and psychological well-being, including, but not limited to: (1) crisis prevention and intervention; (2) psychiatric assessments and evaluations; (3) individual and group therapy; (4) medication monitoring; (5) nutrition education; and (6) referrals to community resources. Requires the services to be tailored to the community's needs and to be available year-round on a walk-in basis or by appointment to community members regardless of age or insurance coverage. Permits the Department to adopt any rules necessary to implement the program.
Amends the University of Illinois Act. In provisions concerning scholarships for the children of veterans, provides that an honorary scholarship may also be given to the children of persons who served at any time during the invasion of Panama between December 20, 1989 and January 31, 1990.

Provides that a candidate seeking election to an office for which candidates of political parties are nominated by caucus who is a participant in the caucus and who has participated in the caucus of another established political party or a new political party or who has signed a petition of another established political party, a new political party, or an independent candidate is ineligible to be listed on the ballot at that general or consolidated election as a candidate of the political party holding the caucus. Makes conforming changes. Amends the Township Code. Provides that a person shall not be able to participate or vote at any township or multi-township caucus if the person participated in the caucus of another established political party or a new political party or signed a petition for a candidate of another established political party, a new political party, or an independent candidate at anytime during the 12 months before the caucus.

Provides that, beginning July 1, 2026, each State's Attorney whose term begins after July 1, 2026 shall be compensated at the rate of 100% of the mean of the amount paid to the resident circuit judges in the county courthouse for the State's Attorney.. Provides that the State shall furnish 66 2/3% of the total annual compensation to be paid to each State's Attorney in the State based on the salary in effect on December 31, 1988, and 100% of the increases in salary taking effect after December 31, 1988. Provides that the amount shall be paid from the Personal Property Tax Replacement Fund. Provides that the county shall be responsible for the State and federal income tax reporting and withholding and the employer contributions under the Illinois Pension Code.

In provisions concerning the supportive living facilities program, provides that sites for the operation of the program shall be selected by the Department of Healthcare and Family Services based upon criteria that may include the need for services in a geographic area, the availability of funding, the site's ability to meet the standards, and a need to increase access for Medicaid enrollees who need an alternative to nursing home care. Requires the Department to determine need utilizing the most recently available statewide report every 3 years, and to also consider the occupancy rates, vacancies, and waiting lists in surrounding operational supportive living program sites, and public comments. Provides that based on need, the Department shall make the final determination to establish geographic areas utilizing county or zip code-based geographic areas within a rate setting region as the basis for opening a competitive application process. Contains provisions on the analysis and other information required in the statewide report; primary market areas for supportive living program sites; and other matters. Effective immediately.

Sets forth provisions concerning product liability actions brought against a developer of an artificial intelligence system for defective design, failure to contain adequate instructions or warnings, and failure to conform to an express warranty. Provides that a deployer of an artificial intelligence system shall be deemed to be liable as a developer for harm caused by a product if: (1) the deployer makes material and substantial change to the product or (2) the deployer intentionally misuses the product contrary to the express warranty and that use was the proximate cause of harm to the plaintiff. Sets forth provisions concerning applicability and enforcement.

Provides that each chief procurement officer may designate as a veteran-owned small business set-aside a fair proportion of construction, supply, and service contracts for award to veteran-owned small businesses in Illinois. Requires the chief procurement officer to report certain information to the General Assembly.

Creates the Substitute Teacher Background Check Task Force to research and identify paths through legislation, rules, and communication processes to expedite the background check process and provide reciprocity concerning background checks for licensed substitute teachers in the State to teach in school districts across Regional Offices of Education jurisdictions without having to complete multiple background checks. Sets forth meeting requirements, membership, administrative support, and compensation. Requires the Task Force to submit its findings in a report on or before October 31, 2026 to the State Board of Education and the General Assembly. Dissolves the Task Force upon submission of its report. Effective immediately.
