REGULATION-TECH

Amends the Comprehensive Health Insurance Plan Act. Makes a technical change in a Section concerning the short title.

CD CORR-CONSECUTIVE SENTENCES

Amends the Unified Code of Corrections. Provides that for sentences imposed under the law in effect on or after February 1, 1978, exempts the offenses of possession of child sexual abuse material and the former offenses of possession of child pornography and possession of aggravated child pornography from the provision that offenses that were committed as part of a single course of conduct during which there was no substantial change in the nature of the criminal objective that the aggregate of consecutive sentences shall not exceed the sum of the maximum terms authorized under the Code for the 2 most serious felonies involved.

CRIM PRO-JURY TRIAL WAIVER

Amends the Code of Criminal Procedure of 1963. Provides that a person accused of an offense does not have the right to a trial by jury if the offense is a petty offense with no penalty of imprisonment or mandatory driver's license suspension under the Illinois Vehicle Code or a local traffic ordinance if a court appearance is not required and the defendant waives his or her right to a jury trial by mail or electronic submission of a waiver request through an online system approved by either the Illinois Supreme Court or the local circuit court clerk. Provides that every person accused of an offense pursuant to the provision and entering a plea of not guilty may waive the right to a trial by jury and request a bench trial by submitting a jury waiver request in writing or such other form prescribed by the Illinois Supreme Court or a local circuit court by mail to the clerk of the circuit court in the county where the charge is pending or by electronic submission, through an online system approved by the Illinois Supreme Court or the local circuit court clerk. Provides that the jury trial waiver request under the provision shall include the name, mailing address, driver's license number, citation or complaint number, date of birth, and signature of the defendant. Provides that upon the receipt of a valid waiver request, the clerk of the court before which such request was made shall schedule the matter for a bench trial, enter the waiver into the court record, and the court may proceed with a bench trial without requiring the defendant to personally appear to execute the waiver. Provides that the waiver shall be deemed sufficient to satisfy the waiver requirements of the Code. Provides that the trial court may require the defendant to appear in court if necessary to confirm the validity of the waiver or for a show of good cause. Provides that nothing in the provision shall preclude the Illinois Supreme Court from adopting rules forms and procedures for the implementation of the provision. Makes other changes. Effective January 1, 2027.

DHS-TRANSITION PROGRAM GRANTS

Amends the Department of Human Services Act. In provisions concerning the transition program grants to assist eligible community agencies with active or pending Section 14(c) certificates to transition away from subminimum wages for workers with disabilities, requires the Department of Human Services to ensure equitable access to transition grants for all eligible holders of Section 14(c) certificates by (i) avoiding the concentration of funding among a limited number of grant recipients and (ii) promoting equity in the distribution of funds by being inclusive of all geographic regions of the State, provider sizes, and transition needs. Provides that every applicant that applies for grant funds and meets the grant criteria established by the Department shall be awarded a grant in an amount based upon the Department's funding criteria. Requires grant recipients to submit progress reports to the Department twice annually on a form developed by the Department in consultation with the Illinois Council on Developmental Disabilities. Sets forth the information required in the reports. Requires the Department to aggregate data collected from the reports and make it publicly available on an annual basis. Amends the Employment and Economic Opportunity for Persons with Disabilities Task Force Act. Requires the Department to ensure that there is project management for statewide implementation of the multi-year plan under the Dignity in Pay Act, Public Act 103-1060, through December 31, 2029. Sets forth a list of project management responsibilities. Requires the Department to ensure the availability of ongoing technical assistance to eligible Section 14(c) certificate holders throughout the transition period ending on December 31, 2029. Sets forth the type of technical assistance to be provided. Provides that funds appropriated for Section 14(c) transition purposes may be used for (i) transition program grants to eligible providers, (ii) statewide project management and coordination, and (iii) technical assistance and capacity-building supports. Effective immediately.

LIQUOR-TECH

Amends the Liquor Control Act of 1934. Makes a technical change in a Section concerning the short title.

STATE GOVERNMENT-TECH

Amends the Civil Administrative Code of Illinois. Makes a technical change in a Section concerning the short title.

CRIM PRO-PRETRIAL DETENTION

Amends the Code of Criminal Procedure of 1963. Provides that if the State files a petition seeking to deny the defendant pretrial release and a continuance on the hearing concerning the petition is requested, the court has the sole discretion to grant or deny the request for a continuance. Provides that under no circumstances shall a continuance be granted that would result in the defendant being detained in pretrial detention for longer than 72 hours since the defendant's initial detention. Provides that in making its determination to deny or grant the request for continuance, the court shall consider, in addition to other facts and evidence available to the court, whether there is evidence that reasonable steps have been taken to appear within the initial time frame provided under the provision, but that due to circumstances outside the control of the requesting party, a continuance is necessary to present a fuller case.

CRIM PRO-PRETRIAL REL-REVOKE

Amends the Code of Criminal Procedure of 1963. Provides that when a defendant has previously been granted pretrial release for a felony or Class A misdemeanor, that pretrial release may be revoked after a hearing on the court's own motion or upon the filing of a verified petition by the State if the defendant: (1) is charged with a felony or Class A misdemeanor that is alleged to have occurred during the defendant's pretrial release; (2) has abused or manipulated the pretrial release system causing undue delay on the proceedings; or (3) has shown that he or she will not appear for court regardless of the conditions of release that are imposed (rather than when a defendant has previously been granted pretrial release for a felony or Class A misdemeanor, that pretrial release may be revoked only if the defendant is charged with a felony or Class A misdemeanor that is alleged to have occurred during the defendant's pretrial release). Establishes procedures for the pretrial release revocation hearings. Provides that the revocation hearing shall occur within 96 (rather than 72) hours of the filing of the State's petition or the court's motion for revocation. Provides that sanctions for violations of pretrial release may include imprisonment in the county jail for a period not exceeding 60 (rather than 30) days.

INS-LUNG CANCER SCREENING

Amends the Illinois Insurance Code. Provides that no policy of accident and health insurance shall be issued, amended, delivered, or renewed in this State on or after January 1, 2027 unless the policy provides coverage for annual lung cancer screenings for any beneficiary currently employed as an active firefighter or any person eligible for or currently receiving a retirement annuity, retirement pension, disability pension, or disability benefit pursuant to the Downstate Firefighter or Chicago Firefighter Article of the Illinois Pension Code. Requires the coverage to be provided without cost sharing. Amends the Counties Code, the Township Code, the Illinois Municipal Code, and the Illinois Public Aid Code to require coverage under the provisions of those Acts.

REGULATION-TECH

Amends the Behavior Analyst Licensing Act. Makes a technical change in a Section concerning the short title.

COURTS-TECH

Amends the Supreme Court Historic Preservation Act. Makes a technical change in a Section concerning the short title.

FINANCE-TECH

Amends the Agricultural Fair Act. Makes a technical change in a Section concerning the short title.

FAMILY LAW-USE OF DEFINTIONS

Creates the Family Law Definitions Act. Defines and requires the use of the terms "high conflict", "parental alienation", and "safe parent" in family law cases. Provides that no alternative similar terms may be used or invented if their use or interpretation has the purpose or effect of evading compliance with these definitions. Provides that failure by a court to apply these definitions, if applicable, is reversible legal error and is cause for an appeal.

OVERSIGHT-CONDO & COM INT ASSN

Amends the Common Interest Community Association Act and the Condominium Property Act. Authorizes the Department of Financial and Professional Regulation to investigate, make findings, or make recommendations for enforcement on behalf of unit owners of common interest community and condominium associations whose rights have been violated by the owners' governing board under Illinois law or under the board's governing documents. Amends the Financial Institutions Act. Authorizes the Department to administer and enforce these provisions on behalf of unit owners and adopt rules to implement the Act. Effective July 1, 2027.

CIVIL LAW-TECH

Amends the Code of Civil Procedure. Makes a technical change in the short title Section.

NON-PROFIT INVESTMENT POOL

Amends the State Treasurer Act. Provides that the State Treasurer may establish and administer a non-profit investment pool and an electronic payment processing program to supplement and enhance investment opportunities and secure electronic payment options otherwise available to not-for-profit corporations in the State. Provides that the Treasurer may receive funds paid into the pool for the purpose of holding and investing those funds. Provides for surety bonds payable to not-for-profit corporations who participate in the pool. Provides that the Treasurer shall adopt rules for the efficient administration of the pool.

FINANCE-GEO-KARIS BEACH FUND

Amends the State Finance Act. Provides that revenue from the North Point Marina State Recreation Area shall be deposited into the Adeline Jay Geo-Karis Illinois Beach Marina Fund. Provides that the Adeline Jay Geo-Karis Illinois Beach Marina Fund may receive moneys from the General Revenue Fund and from any other lawful source. Provides that moneys in the Adeline Jay Geo-Karis Illinois Beach Marina Fund may be used only for purposes related to the North Point Marina State Recreation Area in Lake County.

WILDLIFE CD-MUZZLELOAD PISTOL

Amends the Wildlife Code. In provisions regarding allowing hunting deer with muzzleloading rifles, allows hunting deer with muzzleloading pistols. Provides that, within one year, the Department of Natural Resources shall adopt rules that allow for hunting deer with a muzzleloading pistol in the same seasons and under the same or similar restrictions as hunting deer with a muzzleloading rifle.

SUPERVISED PARENTING-FAIRNESS

Creates the Supervised Parenting Safety and Fairness Act. Makes legislative findings. Requires that before a court may order supervised parenting time, it must determine whether qualified supervisors are reasonably available within the child's geographic area and shall document the inquiry. Requires that if supervision is warranted, the court may not order or permit unsupervised parenting time solely because no qualified supervisor is available. Provides that if no qualified supervisor is available, the court shall maintain the restriction on unsupervised parenting time and order one or more statutorily authorized alternatives, including temporary suspension of in-person parenting time, virtual contact, therapeutic supervised contact, or other protective measures necessary to ensure safety. Provides a rebuttable presumption of supervised parenting time: (1) in any case in which that parent has committed abuse against the child or the other parent based on a preponderance of the evidence; (2) when the other parent has an active order of protection against the parent in question which has been upheld or extended after a hearing. Provides that evidence of abuse may not be given weight if it appears more probable than not to be manufactured or the product of coaching or fabricated, unless and until it can be independently corroborated.

SCH CD-CHARTER RENEWAL REQ

Amends the Charter Schools Law of the School Code. Provides that a charter school's failure to adequately address racial, socioeconomic, or educational disparities between a school district and the charter school or failure to align the charter mission and vision to a school board's mission and vision are both reasons for the school board or State Board of Education, as the chartering entity, to revoke or not renew a charter. Effective immediately.

LOC GOV ESSENTIAL SERVICES ACT

Creates the Local Government Essential Services Act. Defines "emergency medical services". Provides that emergency medical services shall be deemed an essential service in the State. Provides that the governing body of each municipality and county in the State shall ensure the availability of emergency medical services to provide for the needs of its population. Provides that the governing body of each municipality and county may provide emergency medical services by (1) providing a license or franchise to a private company; (2) contracting with a public, private, or nonprofit entity for emergency medical services; (3) entering into agreements with other units of local government; or (4) entering into agreements with hospitals, clinics, or any medical facility.

PRETRIAL RELEASE-REASONS&JUDGE

Amends the Illinois Criminal Justice Information Act. Provides that the quarterly data collected by the Pretrial Practices Data Oversight Board shall include the identity of the judges who preside over the pretrial detention hearings and the number of detention petitions each judge grants and denies. Amends the Code of Criminal Procedure of 1963. Provides that the court shall, in any order denying detention, make a written finding summarizing the court's reasons for concluding that the defendant should not be denied pretrial release, including why the defendant has been determined not to be a real and present threat to the safety of any person or persons or the community, based on the specific articulable facts of the case, or that the defendant does not have a high likelihood of willful flight from prosecution.

CD CORR-ELECTRONIC FND CAP

Amends the Unified Code of Corrections concerning the transfer of committed persons funds. Provides that the Department of Corrections and the Department of Juvenile Justice shall not enter into or renew any contract with a vendor that provides electronic funds transfer services that include total fees and charges of more than 2% of the total amount of funds being transferred or $15 per transaction, whichever is less, for the privilege of electronically transferring funds. Effective immediately.

Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning findings and purpose.
