Illinois HB5536 regulates the use of credit and claims information in personal insurance underwriting.

HB5536 amends the Use of Credit Information in Personal Insurance Act, renaming it the Use of Credit and Claims Information in Personal Insurance Act. It defines "claims information" as any communication that provides access to consumer claims data. Insurers using credit information cannot consider claims from negligent or intentional third-party actions or those not covered by the policy. However, they can consider claims resulting from consumer fraud.
