ED TASK FORCE-HISPANIC-SERVING

Creates the Hispanic-Serving Institutions Task Force Act. Creates the Hispanic-Serving Institutions Task Force. Sets forth provisions regarding administrative support, membership, compensation, meetings, and hearings. Requires the Task Force to assess the current landscape of Hispanic-serving institutions and emerging Hispanic-serving institutions in the State; identify barriers to student access, retention, and completion; review existing State policies, funding formulas, and accountability frameworks to determine their impact on Hispanic-serving institutions and their students' success; examine best practices from other states related to supporting Hispanic-serving institutions; develop recommendations to improve access to and success in higher education for students, strengthen institutional capacity, improve coordination between State agencies and Hispanic-serving institutions, align Hispanic-serving institutions' efforts with State workforce and economic development priorities, and consider the feasibility of creating a permanent State initiative, designation, or funding mechanism to support Hispanic-serving institutions. Requires the Task Force to submit a written report to the Governor and the General Assembly on the Task Force's findings and recommendations for legislative, administrative, or budgetary action. Requires the Board of Higher Education and the Illinois Community College Board to each post the report on their respective public websites. Dissolves the Task Force upon the submission of its report to the Governor and General Assembly. Repeals the Act on January 1, 2029. Effective immediately.

ESTATE TAX-FEDERAL EXCLUSION

Amends the Illinois Estate and Generation-Skipping Transfer Tax Act. Provides that, for persons dying on or after January 1, 2027, the exclusion amount for purposes of the Act is the applicable exclusion amount set forth in Section 2010 of the Internal Revenue Code. Effective immediately.

EMERGENCY NOTIFICATION

Amends the Community-Integrated Living Arrangements Licensure and Certification Act. In a provision requiring a facility licensed under the Act to notify the Department of Human Services when emergency calls are made from the facility, provides that the notification is required regardless of whether the Office of the Inspector General has substantiated the allegations or the call resulted in a criminal charge, arrest, or incarceration. Provides that the Department shall adopt by rule a definition for "emergency calls".

VETS ASSISTANCE COMM-BUDGET

Amends the Military Veterans Assistance Act. Provides that for each fiscal year after January 1, 2027, each Veterans Assistance Commission shall prepare a budget and publish the budget on its official website. Provides that a public hearing on the contents of the budget shall occur within 30 days of its publication. Provides that the budget must be approved by the full Commission membership and by the county board of the county where the Veterans Assistance Commission is organized. Requires each Veterans Assistance Commission to follow the same procurement and bidding procedures as its respective county or the largest sponsoring government entity based on financial contribution, not population. Provides that all Veterans Assistance Commissions are subject to the Freedom of Information Act. Effective immediately.

SWITCH NETWORK SALVAGE

Amends the Public Utilities Act. In provisions concerning a Large Electing Provider's transition to IP-based networks and service, provides that a Large Electing Provider shall provide telecommunications service, including telecommunications service over traditional circuit switched networks, to existing business and residential end-use customers until at least December 31, 2031. Provides that, beginning January 1, 2032, a Large Electing Provider shall start the process of returning the salvage value of traditional circuit switched networks to the people of the State. Requires a Large Electing Provider to complete the salvage of the Large Electing Provider's traditional circuit switched networks by January 1, 2038. Provides that the Large Electing Provider shall document and report to the Department of Public Health and the Illinois Commerce Commission, on a quarterly basis, all activities related to the salvage of the Large Electing Provider's traditional circuit switch networks, including, but not limited to, the total realized salvage value, a per-mile salvage value, the geographic location of all salvages, and the value of such salvages. Provides that, if a Large Electing Provider retires a traditional circuit switch network, the Large Electing Provider shall, beginning on December 1, 2032 and annually thereafter, transfer the salvage value of the retired networks to the Lead Service Line Replacement Fund for the sole purpose of providing grants to municipal and private water utilities to replace lead service lines. Effective immediately.

NEW CHILD BONDING LEAVE ACT

Creates the New Child Bonding Leave Act. Provides that an employee who has gained custody of a child within the previous 4 weeks, either through birth, adoption, foster care placement, or otherwise, is entitled to 12 weeks of unpaid leave. Provides that an employer shall not require that an employee use any paid leave available to the employee for any reason instead of leave the employee is entitled to under the Act. Provides that, upon the conclusion of leave taken under the Act, an employee shall be reinstated to the employee's former position or a substantially equivalent one with no loss of benefits held or accrued prior to taking leave. Allows an employer to require an employee submit documentation to demonstrate that they are entitled to leave under the Act. Sets forth provisions concerning unlawful employer practices; Department of Labor responsibilities; and enforcement of the Act.

CONVEY TAMMS CORRECTIONAL CTR

Authorizes the Director of Corrections to convey the real property and buildings of the former Tamms Correctional Center to Alexander County that is authorized to lease it for a public purpose of health.

INNKEEPER PROTECTION ACT

Amends the Innkeeper Protection Act. Provides that a hotel does not include any facility that provides emergency shelter or emergency housing to persons who are unhoused or unsheltered and (1) a person's admission to the facility is limited to a single overnight stay or is renewable on a daily basis; and (2) the facility does not require the payment of any fees by these persons for admission to the facility. Effective immediately.

GAMING-SPORTS WAGERING LICENSE

Amends the Sports Wagering Act. Provides that applicants for a master sports wagering license shall pay an application fee of $250,000 and a license fee of $15,000,000. Removes provisions concerning the number of master sports wagering licenses to online sports wagering operators and public notice requirements. Provides that a master sports wagering licensee may conduct sports wagering over the Internet or through a mobile application. Removes provisions concerning eligibility requirements for a master sports wagering license, the duty of disclosure for an applicant, and outreach requirements for the Department of Commerce and Economic Opportunity and the Illinois Gaming Board. Makes a conforming change. Effective immediately.

WILDLIFE CD-UAV TRACKING

Amends the Wildlife Code. Provides that tracking wounded wild birds or wounded wild mammals by use of unmanned aircraft is permissible under certain conditions, including that: (1) the wild bird or wild mammal is wounded when a properly licensed hunter has struck the animal with a projectile fired from a legal hunting device during the open season; (2) any person operating the unmanned aircraft has obtained permission from the public or private landowner, or the landowner's authorized representative, before launching or landing the unmanned aircraft from or on the landowner's property; (3) the person operating the unmanned aircraft does not possess or control a firearm, bow, or other implement whereby wildlife could be killed or taken while afield, whether acting singly or as a group of persons while the unmanned aircraft is in flight, except this prohibition does not apply to a person lawfully carrying a concealed firearm under the Firearm Concealed Carry Act if the concealed firearm is not used to take wildlife; and (4) the unmanned aircraft is operated in a manner that does not harass any wildlife. Exempts an operator of an unmanned aircraft that meets these conditions from hunting permit requirements if the operator is not the taker of the wounded animal. Effective July 1, 2027.

COMMUNITY-INTEGRATED LIVING

Amends the Community-Integrated Living Arrangements Licensure and Certification Act. Removes provisions allowing the Department of Human Services to conduct site visits to an agency licensed under the Act, or to any program or placement certified by the agency, and inspect the records or premises, or both, of such agency, program or placement as it deems appropriate, for the purpose of determining compliance with the Act, the Mental Health and Developmental Disabilities Code, and applicable Department rules and regulations. Requires the Department to establish a system of regular, ongoing, and unannounced on-site inspections, that shall occur at least annually, of each agency licensed under the Act or any program or placement certified by an agency licensed under the Act under the Department's jurisdiction. Provides that the inspections shall be conducted by the Department's central office to achieve specified goals.

STATE GROUP INS-DEPENDENTS

Amends the State Employees Group Insurance Act of 1971. Provides that if both spouses are eligible covered members and are employees under the State Employees Article of the Illinois Pension Code, then one spouse may enroll the other spouse as an eligible dependent if: (1) both spouses provide to the Department of Central Management Services, upon the request of the Department of Central Management Services, an attestation that the member and the member's spouse have elected for the spouse to be enrolled as a dependent; and (2) the spouses continue to be married. Provides that upon electing to enroll in the program of group health benefits as an eligible dependent under the amendatory provisions, a member forfeits his or her rights as a member under the Act with respect to the program of group health benefits during the period when that election is in effect. Makes conforming changes to the definition of "dependent" and provisions concerning contributions.

CD CORR-MSR-SEX OFFENSE-PLACE

Amends the Unified Code of Corrections. Provides that an individual convicted of a sex offense and released from the Department of Corrections to mandatory supervised release shall, to the extent practicable, be placed on mandatory supervised release in either: (1) the sentencing community or (2) a community of connection. Provides that placement outside the sentencing community or a community of connection may occur only upon a documented determination by the Department of Corrections that such placement is necessary due to one or more of the following: (1) verified public safety concerns; (2) victim safety considerations, including the location of a victim or the existence of protective orders; (3) the unavailability of compliant housing that satisfies statutory or mandatory supervised release conditions; or (4) the unavailability of required treatment, monitoring, or supervision resources. Provides that prior to release, the Department of Corrections shall develop an individualized reentry plan for each individual subject to the provision that identifies the sentencing community and any communities of connection and evaluates appropriate housing, treatment, and supervision options. Provides that nothing in the provision shall be construed to limit the authority of the Department of Corrections to impose conditions of mandatory supervised release necessary to protect public safety or to comply with existing law. Provides that the Department of Corrections shall submit an annual report to the General Assembly no later than March 1 of each year containing aggregate data regarding: (1) mandatory supervised release placement patterns for individuals convicted of sex offenses; (2) the number of placements made outside sentencing communities or communities of connection; (3) the primary reasons for such placements; and (4) geographic distribution by county. Provides that the report shall not include personally identifying information. Defines "sex offense", "sentencing community", and "community of connection". Effective immediately.

ELEC CD-DECEPTIVE MATERIAL

Amends the Election Code. Provides that a person shall not distribute, or enter into an agreement with another person to distribute, materially deceptive media if: (1) the person knows the media falsely represents a depicted individual; (2) the distribution occurs within 90 days before an election; (3) the person intends the distribution to harm the reputation or electoral prospects of a candidate in an election and the distribution is reasonably likely to cause that result; and (4) the person intends the distribution to change the voting behavior of electors in an election by deceiving the electors into incorrectly believing that the depicted individual in fact engaged in the speech or conduct depicted, and the distribution is reasonably likely to cause that result. Sets forth exceptions to the provision and penalties for violations of the provision. Effective immediately.

INC TX-EMPLOYMENT DISABILITIES

Amends the Illinois Income Tax Act. Provides that a taxpayer who employs a person with a developmental disability or a severe mental illness, as certified by the Department of Human Services, during the taxable year is entitled to an income tax credit in an amount equal to 25% of the wages paid by the taxpayer to the person with a developmental disability or severe mental illness, but not to exceed $6,000 in wages paid during the taxable year to any single qualified employee. Effective immediately.

NEWBORN SAFETY DEVICE

Amends the Abandoned Newborn Infant Protection Act. Provides that as soon as practicable, the Department of Children and Family Services, in consultation with the county board of each county, shall identify hospital emergency departments, fire stations, emergency medical facilities, and police stations to install, maintain, and provide outreach regarding newborn safety devices. Provides that each county having a population less than 500,000 shall identify one hospital emergency department, fire station, emergency medical facility, or police station to install a newborn safety device; and each county having a population greater than 500,000 shall identify a total of 4 hospital emergency departments, fire stations, emergency medical facilities, or police stations, or any combination of those facilities, to install a newborn safety device. Requires the Department to award grants to the designated facilities of each county to pay for the installation of a newborn safety device and any other costs associated with maintaining proper operation of the device. Provides that a designated facility's acceptance of the grant award and any agreement to install and maintain a newborn safety device shall be strictly voluntary. Provides that a hospital emergency department, fire station, emergency medical facility, or police station that operates a newborn safety device is immune from civil liability for an act or omission relating to the operation of the newborn safety device unless the act or omission constitutes gross negligence or willful or wanton misconduct. Makes conforming changes throughout the Act.

KIDNEY TREATMENT DELEGATE ACT

Creates the Kidney Disease Treatment Delegation Act. Provides that, notwithstanding any provision of the Nurse Practice Act or any rule of the Department of Financial and Professional Regulation to the contrary, delegation, including, but not limited to, delegation of the performance of central venous catheter procedures in a kidney disease treatment center, shall only be allowed if the individual receiving delegation is a licensed practical nurse who has obtained the proper training, education, and experience or a certified dialysis technician who currently holds, or is in the process of acquiring, the necessary experience to apply for and obtain certification as a certified clinical hemodialysis technician by the Nephrology Nursing Certification Commission or a Certified Hemodialysis Technologist/Technician by the Board of Nephrology Examiners Nursing and Technology. Sets forth additional provisions concerning delegation of duties in a kidney disease treatment center. Provides that the Department is authorized to adopt rules for the administration and enforcement of the Act, and the rules may define standards and criteria for the necessary training, education, and experience for licensed practical nurses to obtain before receiving delegation under the Act. Amends the Nurse Practice Act. Provides that a violation of the Kidney Disease Treatment Delegation Act is grounds for disciplinary action. Effective immediately.

CAREGIVER EMPOWERMENT

Amends the Illinois Act on the Aging. Provides that the Department on Aging shall require all provider agencies to administer annual enhanced training for all covered aides regarding all of the following: (1) ethical boundaries and conflicts of interest; (2) the fiduciary duties of an agent under the Illinois Power of Attorney Act; and (3) recognizing and reporting signs of financial exploitation and self-neglect. Provides that a covered aide shall not serve as the agent for a program participant in the Community Care Program unless all of the following conditions are met: (1) the family caregiver discloses the dual role in writing to the provider agency and the Department; (2) the participant undergoes a cognitive capacity assessment by a qualified physician or clinical psychologist confirming the participant understands the dual role and, if the participant lacks capacity, the dual role is permitted only if the agency designation was executed prior to the loss of capacity; and (3) the family caregiver agrees to comply with an administrative oversight mechanism. Amends the Adult Protective Services Act. Provides that a covered aide operating as an agent carries an enhanced duty to report. Amends the Illinois Power of Attorney Act. Allows a covered aide to serve as a health care agent for a program participant in the Community Care Program if the requirements of the Illinois Act on the Aging are met.

SCH CD-ALTERNATIVE SCH-FUNDING

Amends the Safe Schools Law of the School Code. In provisions concerning funding, provides that in any fiscal year in which the State funding allocation is at or above $22,730,000, each alternative school program shall receive $100,000 for that fiscal year (instead of receiving funding in the amount of $30,000), plus an amount based on the ratio of an educational service region's or the Chicago public school system's average student enrollment (instead of best 3 months' average daily attendance in grades pre-kindergarten through 12) to the statewide totals of these amounts. Makes conforming changes. Effective immediately.

HEMP REGULATION REFORM

Amends the Illinois Food, Drug and Cosmetic Act. Provides that, notwithstanding any other provision of law, a food, food ingredient, dietary supplement, cosmetic, or other consumer product shall not be considered adulterated solely because it contains hemp, hemp-derived cannabinoids, including, but not limited to, Delta-9 tetrahydrocannabinol (THC), Delta-8 THC, tetrahydrocannabinolic acid (THCa), or any hemp product, provided that the hemp used in the product complies with the definition of "hemp" as specified in federal law. Amends the Industrial Hemp Act. Conforms several provisions in the Act to federal regulations under the Domestic Hemp Production Program, including (i) definitions, (ii) requirements for the application for a license to cultivate hemp, and (iii) rulemaking requirements for the Department of Agriculture. Provides that the Department of Agriculture shall adopt rules for the distribution and retail sale of hemp products under conditions in specified provisions of the Act. Provides that hemp products that contain cannabinoids, that are intended for human consumption, and that are designated for retail sale within Illinois (i) must meet specified requirements, including federal requirements and rules adopted by the Department of Public Health, and (ii) must be distributed or sold in a container that includes specified information. Provides that hemp products that are intended for inhalation or ingestion and contain detectable amounts of hemp cannabinoids may not be sold in this State to a person who is under 21 years of age. Provides that hemp products distributed or sold in violation of specified provisions in the Act shall be considered adulterated or misbranded pursuant to the Illinois Food, Drug and Cosmetic Act and all other applicable State laws. Defines terms. Makes technical changes.

HOSPITAL TRANSPORT DISCLOSURE

Amends the Hospital Licensing Act. Provides that, before transporting a patient to a hospital facility, the hospital must inform the patient of the costs associated with transportation to the facility. Provides that a hospital must also conspicuously list on the hospital's publicly accessible website the cost of transporting a patient to a hospital facility. Amends the University of Illinois Hospital Act to require the University of Illinois Hospital to comply with those requirements.

REGULATION-TECH

Amends the Network Adequacy and Transparency Act. Makes a technical change in a Section concerning the Act's short title.

FOIA-BUSINESS DAY

Amends the Freedom of Information Act. Defines "business day" as Monday through Friday, not including Saturday, Sunday, and specified holidays. In provisions regarding requests for commercial purposes, changes a reference to 21 working days to a reference to 21 business days.

TOBACCO TAX-REMOTE SELLERS

Amends the Tobacco Products Tax Act of 1995. Provides that remote retail sellers that meet certain sales criteria are required to collect and remit the tax under the Act. Provides that, beginning on January 1, 2027, the tax under the Act is 45% of (i) the actual cost paid by a distributor or remote retail seller for the stock keeping unit or (ii) if documentation of the actual cost is not available due to matters beyond the distributor or remote retail seller's control, the actual cost list paid by the distributor or remote retail seller for the stock keeping unit. Provides that, beginning January 1, 2027 and continuing through December 31, 2029, the tax per cigar sold or otherwise disposed of in the State, other than a little cigar, shall not exceed $0.75 per cigar. Effective January 1, 2027.

VEH CD-CANNABIS IN VEHICLE

Amends the Illinois Vehicle Code. Removes the requirement that cannabis within any area of a motor vehicle must be in an odor-proof container.
