Making WV State Police Forensic Laboratory responsible for certification and standards for DUI tests

The purpose of this bill is to make the West Virginia State Police Forensic Laboratory the entity responsible for the certification, standards, and administration of secondary chemical tests. The bill also makes the West Virginia State Police Forensic Laboratory responsible for approval of the devices and methods of preliminary breath analysis. The bill transfers rule-making authority from the Bureau of Public Health to the State Police.

Relating to filing of fraudulent financing statement

The purpose of this bill is to update acts constituting the filing of a fraudulent financing statement; filing of an affidavit and notice to secured parties; investigative powers of the Secretary of State; removing outdated provisions of code.

Providing a cost-of-living provision for certain persons retired under the Public Employees Retirement System and the Teachers Retirement System

The purpose of this bill is to provide a cost-of-living increase, based on the annual increase in the consumer price index, for persons under the Public Employees Retirement Act and Teachers Retirement System who are at least 60 years of age and that have received retirement payments for at least five years.

Relating to standard of proof required for final parole or probation revocation hearing

The purpose of this bill is to clarify the standard of proof required for a final parole or probation revocation hearing is proof by a preponderance of the evidence.

Amending the procedures for determining liability for exposures to asbestos or silica.

The purpose of this bill is to amend the procedures for the handling of asbestos and silica litigation and to enhance the ability of the judicial system to manage such litigation.

Supplemental Appropriation to Department of Agriculture, fund 0131

The purpose of this bill is to create the Health Freedom for Teachers and Students Act of 2026.

Relating to Hope Scholarships awards

The purpose of this bill is to help to preserve funding for public schools and insure fairness in the use of Hope Scholarship funds; allowing Hope tuition reimbursements only to instate schools; establishing a family income eligibility schedule for Hope scholarships; requiring Hope recipients reimburse public schools the costs of providing individualized instruction programs; requiring Hope participants to utilize college exam and testing preparation course available in public school schools; requiring the state Board of Education to provide rules for implementation of cost and payment reimbursements for public school costs for services provided to Hope recipients; and to provide directives to assure county schools are reimbursed for services provided to Hope scholarship recipients.

Requiring Secretary of State notify respondent of election law complaint

The purpose of this bill is to provide that the Secretary of State shall notify a respondent of an election law complaint, and that the respondent shall provide a response within ten business days.

The purpose of this bill relates to municipalities that have failed to complete required financial audits for multiple years; modify definitions; clarify fiscal emergency conditions; authorize State Auditor to evaluate a municipality's likelihood of financial recovery; allow for the transition to dissolution; provide notice to municipalities; clarify duties of receiver upon dissolution; and confirm the effect of municipal dissolution on utilities governed by the Public Service Commission.

The purpose of this bill is to remove the requirement that a kindergarten, preschool, or school education program operated by a private, parochial, or church school be recognized by West Virginia Department of Education Policy 2330 in order to be exempt from the section of code imposing certain childcare related licensure, approval, certification, and registration requirements.

Clarifying definition of “farm” or “farmland” for real property tax assessment purposes

The purpose of this bill is to clarify the definition of farm for property tax assessment purposes to prevent disqualification of certain acreage in which other business activities not farming are performed.
