AUTO LICENSE PLATE RECOGNITION

Creates the Automated License Plate Recognition System Act. Sets forth provisions regarding authorized uses of an automated license plate recognition system, data retention, prohibited uses of an automated license plate recognition system, restrictions, requirements for use, preservation and disclosure, required data collection, reporting requirements, admissibility, privacy, penalties, and a private right of action. Makes a conforming change in the Freedom of Information Act. Effective immediately.

EDUC-QLFD COMMUNITY FOUNDATION

Amends the Workforce Development through Charitable Loan Repayment Act. Changes the definition of "qualified community foundation" to mean a community foundation or similar publicly supported organization that is organized or operating in the State and that (i) for applications submitted before July 1, 2025, substantially complies with the national standards for U.S. community foundations established by the Community Foundations National Standards, (ii) for applications or renewals submitted on or after July 1, 2025 and before July 1, 2026, has received or applied for the Community Foundations National Standards accreditation seal, or (iii) for applications or renewals submitted on or after July 1, 2026, has received the Community Foundations National Standards accreditation seal. Effective immediately.

DHFS-FFS SUPPLEMENTAL PAYMENTS

Amends the Hospital Provider Funding Article of the Illinois Public Aid Code. Provides that, beginning January 1, 2027, if an Illinois freestanding psychiatric hospital reopens a previously closed hospital facility within 4 calendar years of that hospital facility's closure, and the previously closed hospital facility qualified for fee-for-service supplemental payments, then the Illinois freestanding psychiatric hospital shall receive an annual payment equal to $200 per covered inpatient day contained in paid fee-for-service claims and $200 per paid fee-for-service outpatient claim for dates of service of the closed hospital facility in Calendar Year 2019 in the Department of Healthcare and Family Services' Enterprise Data Warehouse as of May 11, 2020. Provides that "closed hospital facility" includes hospitals that have been terminated from participation in the medical assistance program. Effective immediately.

INC TX-WHOLESOME FOOD

Amends the Illinois Income Tax Act. Creates an income tax deduction in an amount equal to 25% of the amount of the federal tax credit received for a donation of apparently wholesome food. Effective immediately.

PROMPT PAYMENT-INTEREST

Amends the State Prompt Payment Act. Makes technical changes to eliminate obsolete provisions. Provides that, if an agency incurs an interest liability that cannot be charged to the same expenditure authority account to which the related goods or services were charged due to federal prohibitions, the agency may pay the interest from any moneys appropriated to the agency that are not otherwise prohibited to be used for the purpose of paying interest. Provides that, when a State official or agency responsible for administering a contract receives a bill or invoice from a contractor, that State official or agency shall confirm the date on which the bill or invoice was received within 15 business days of receipt and shall transmit any approved amount to the Comptroller within 30 days of receipt. Provides that a State official or agency that is responsible for administering a contract submits a voucher to the Comptroller for payment, the official or agency shall make available electronically the voucher number, the date of the voucher, and the amount of the voucher within 15 days after submitting the voucher to the Comptroller (currently, that information shall be made available promptly).

STATE DISABILITY OMBUDSPERSON

Creates the State Disability Ombudsperson Act. Creates the State Disability Ombudsperson within the Department of Human Rights. Provides that on or before July 1, 2026, the Ombudsperson shall offer training, outreach, and educational materials and may arrange for the offering of courses open to the public in disability services and training and related topics. Requires the Ombudsperson to provide a toll-free number available during business hours to provide information and resources under the Act. Requires the Ombudsperson to develop a process for receiving and reviewing complaints. Provides that if the Ombudsperson believes that a complaint has reasonable grounds to have been made, establish a procedure for referral to disability rights organizations, community-based services, and legal and courtroom advocacy if those services are requested or deemed adequate. Requires the Ombudsperson to submit an annual report to the General Assembly. Authorizes the Department of Human Rights to adopt rules to implement the Act. Makes other changes.

SOCIAL MEDIA AGE RESTRICTION

Creates the Social Media Age Restriction Act. Provides that an operator of a social media platform shall take reasonable steps, including the implementation of an age assurance system, to prevent a child from creating or maintaining an account on the social media platform. Provides that an operator may enter into an agreement with application distribution services or device manufacturers to allow for user information to be shared for age assurance purposes. Provides that the provision does not apply to a parent or guardian who allows a child to use an account held by the parent or guardian. Sets forth provisions concerning a 30-day cure period and civil penalties. Provides that an operator shall have 180 days after the effective date of the Act to comply with the requirements of the Act. Effective immediately.

ELECTRONIC CIG REQUIREMENTS

Amends the Prevention of Tobacco Use by Persons under 21 Years of Age and Sale and Distribution of Tobacco Products Act. Provides that before electronic cigarettes may be sold in the State, each manufacturer of such products shall register its electronic cigarette products with the Department of Revenue and shall submit an affidavit to the Department of Revenue. Describes the form of the affidavit. Provides that the information in the affidavit shall be compiled in a registry maintained by the Department of Revenue, updated daily, and made publicly available on the Department's website. Provides that the Department of Revenue, the Department of Public Health, the Attorney General, and local law enforcement agencies shall enforce these provisions by seizing electronic cigarette products that are not in compliance. Provides that the Department of Revenue shall adopt rules to enforce these provisions. Provides that a manufacturer who violates these provisions is guilty of a Class A misdemeanor. Effective immediately.

CLIMATE CHANGE SUPERFUND

Creates the Climate Change Superfund Act. Creates the Illinois Climate Change Superfund as a special fund in the State treasury. Requires at least 40% of the Fund to be spent on projects that directly benefit disadvantaged communities facing climate change impacts. Directs the Environmental Protection Agency to adopt rules within one year, including regarding the apportionment of liability for climate change for payments into the Fund by responsible parties, regarding qualifying expenditures from the Fund, and regarding an Illinois Climate Change Superfund Program. Requires the Agency to establish procedures to challenge its determinations of liability for climate change and provides for judicial review under the Administrative Review Law. Makes findings. Defines terms. Provides that the Act is severable. Makes conforming changes to the State Finance Act.

RAILROAD MOD CREDIT

Creates the Short Line Railroad Modernization Act. Creates an income tax credit for taxpayers that incur qualified railroad expenditures or qualified new rail infrastructure expenditures. Sets forth the amount of the credit and limitations on the amount of the credit that may be awarded. Amends the Illinois Income Tax Act to make conforming changes. Effective immediately.

UNIV OF IL-VETERAN SCHOLARSHIP

Amends the University of Illinois Act. Provides that a county is entitled to a scholarship in the University of Illinois for the benefit of the children of persons who served in the armed forces of the United States any time on or after August 2, 1990 and until Congress or the President orders that persons in service are no longer eligible for the Kosovo Campaign Medal or the Armed Forces Expeditionary Medal.

AGING-IN-HOME SERVICES-RATES

Amends the Illinois Act on the Aging. Provides that, subject to federal approval, on and after January 1, 2027, rates for in-home services shall be increased to $33.92 to sustain a minimum wage of $20.75 per hour for direct service workers. Requires rates in subsequent State fiscal years to be no lower than the rates put into effect upon federal approval. Provides that in order for a provider of in-home services to be eligible to receive the $33.92 rate, the provider must pay a minimum wage of $20.75 per hour to all direct service workers employed by the provider. Requires providers of in-home services to certify to the Department on Aging that they remain in compliance with the mandated wage increase for direct service workers. Requires each provider of in-home services to submit cost reports to the Department consistent with a specified administrative rule in order to be eligible for the $33.92 rate for in-home services. Provides that fringe benefits shall not be reduced in relation to the described rate increases. Requires the Department, beginning January 1, 2027, to ensure that each in-home service provider spends a minimum of 79% of the total payments the provider receives for home care aide services it furnishes under the Community Care Program on total compensation for direct service workers who furnish those services. Requires annual direct service worker cost reports from providers; and requires the Department to amend existing rules on financial reporting and minimum direct service worker costs to reflect the increase in the direct service worker spending requirement from 77% to 79%.

CANNABIS-VARIOUS

Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Provides that the Department may disclose information collected in the course of an examination of a licensee or registrant to the Office of the Executive Inspector General. Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act and the Retailers' Occupation Tax Act. Provides that, as used in each Act, "adult use cannabis" means cannabis subject to tax under the Cannabis Cultivation Privilege Tax Law and the Cannabis Purchaser Excise Tax Law. Amends the Compassionate Use of Medical Cannabis Program Act. Provides that, beginning July 1, 2026 cultivation centers registered under this Act are subject to regulation exclusively as a cultivation center under the Cannabis Regulation and Tax Act. Amends the Illinois Vehicle Code. Provides that no driver or passenger, otherwise authorized to possess medical cannabis, may within any area of any motor vehicle upon a highway in this State except in a secured, sealed or resealable, odor-proof, and child-resistant container that is inaccessible. Makes other changes. Effective immediately.

PROP TX-SENIOR FREEZE

Amends the Property Tax Code. In provisions concerning the low-income senior citizens assessment freeze homestead exemption, provides that the Chief County Assessment Officer in a county with 3,000,000 or more inhabitants may request full social security numbers or individual taxpayer identification numbers for all members of the applicant's household. Provides that the Chief County Assessment Officer may renew the low-income senior citizens assessment freeze homestead exemption without a new application if the Chief County Assessment Officer is able to confirm both that the applicant still owns and resides in the property and that applicant's household income qualifies for the exemption. Provides that a Chief County Assessment Officer who renews a low-income senior citizens assessment freeze homestead exemption without an annual application shall notify the applicant of both the decision to renew the exemption and the applicant's ongoing duty to report changes in the eligibility of the property to receive the exemption.

AGE-APPROPRIATE DESIGN CODE

Creates the Illinois Age-Appropriate Design Code Act. Provides that all covered entities that operate in the State and process children's data in any capacity shall do so in a manner consistent with the best interests of children. Provides that a covered entity subject to the Act shall take specified actions to protect children's privacy in connection with online services, products, or features, including completing a data protection impact assessment for an online service, product, or feature that is reasonably likely to be accessed by children; and maintain documentation of the data protection impact assessment. Contains provisions concerning additional requirements for covered entities; prohibited acts by covered entities; data practices; enforcement by the Attorney General; limitations of the Act; data protection impact assessment dates; and severability. Amends the State Finance Act to create the Age-Appropriate Design Code Enforcement Fund. Effective immediately.

CREMATORY-CEMETERY REGULATION

Amends the Crematory Regulation Act. Authorizes the Comptroller to issue citations or fines, or both, to licensees. Requires a cemetery authority to implement (i) a standard operating procedure and provide a copy to all employees; and (ii) a medical waste management plan. Authorizes the Comptroller to impose a fine not to exceed $10,000 for each violation under the Act. Allows the Comptroller to refuse to issue a license or take disciplinary action if the applicant or licensee has failed to pay delinquent taxes or child support. Requires the Comptroller, upon revocation or suspension of a license, to notify the county coroner or medical examiner who is responsible for the area where the crematory is located to immediately make arrangements to take possession of bodies and cremated remains and arrange for final disposition of any decedents in the possession of the suspended licensee after consulting with the authorized agents for those bodies. Provides that if no authorized agent can be contacted, the county coroner or medical examiner shall take possession of bodies and cremated remains within 72 hours of notification from the Comptroller. Requires a crematory authority to perform a cremation no more than 60 days from the date the human remains have been delivered to it unless the crematory authority has received specific instructions to the contrary on its cremation authorization form. Requires the crematory authority to notify the Comptroller and the coroner or medical examiner in the county in which the death occurred as to why the cremation cannot be performed if it is not done within the 60-day period. Provides that pacemakers do not need to be removed in alkaline hydrolysis cremations. Requires that cremated remains must be stored in a place free from exposure to the elements and be responsibly maintained until disposal. Makes other changes. Amends the Cemetery Care Act. Provides that if a cemetery authority owning or operating a privately owned cemetery has accepted care funds and is considered abandoned or seeks dissolution, it allows, if no receiver is available, a circuit court to order a willing unit of local government to take over the cemetery. Makes other changes.

PROP TX-SUBDIVISION VALUE

Amends the Property Tax Code. In provisions concerning platted and subdivided but undeveloped property, provides that (i) beginning with the 2025 taxable year, no property's assessed value shall be reduced to less than $150 under those provisions and (ii) beginning with the 2035 taxable year, no property shall be eligible for calculation of its assessed value under those provisions for more than a 10-year period.

LINE OF DUTY ANIMAL CONTROL

Amends the Line of Duty Compensation Act. Includes animal control officers and animal wardens within the scope of the Act. Defines terms.

VIDEO GAMING-VARIOUS

Amends the Video Gaming Act. Provides that each licensed establishment, licensed truck stop establishment, licensed large truck stop establishment, licensed fraternal establishment, or licensed veterans establishment at which video gaming terminals are available shall have a payout device approved by the Illinois Gaming Board. Provides that no cash award for the maximum wager on any individual hand shall exceed the W-2G reporting requirements set by the Internal Revenue Service (rather than $1,199). Provides that cash awards shall be awarded in denominations rounded to the nearest 5 cent credit, with rounding conducted upward or downward as applicable. Sets forth circumstances under which a sales agent or broker may not be compensated. Provides, with exceptions, that a terminal operator shall not enter into any contract or agreement for the sharing, splitting, or payment of net terminal income with any other person. Sets forth prohibitions for sales agents and brokers in relation to current or potential licensed establishments, licensed truck stop establishments, licensed large truck stop establishments, licensed fraternal establishments, and licensed veterans establishments. Provides that no current or potential licensed establishments, licensed truck stop establishments, licensed large truck stop establishments, licensed fraternal establishments, and licensed veterans establishments shall accept anything of value from a terminal operator or sales agent and broker, as any incentive or inducement to locate video gaming terminals in that establishment and licensed establishments, licensed truck stop establishments, licensed large truck stop establishments, licensed fraternal establishments, and licensed veterans establishments. Provides that no public officer may be granted a license under the Act. Sets forth investigation provisions. Makes other changes.

GAS APPLIANCE LABELING

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that no person shall sell, attempt to sell, or offer to sell to a consumer in the State a non-externally vented natural gas appliance that is manufactured on or after January 1, 2027 unless a label on the gas appliance bears a specified warning message. Provides that the Attorney General may adopt rules setting forth additional requirements for the placement and formatting of the label. Provides that a person who violates the provision commits an unlawful practice within the meaning of the Act.

LOC GOV OFFICER'S SALARY

Amends the Property Tax Code. Provides that, elected and appointed supervisors of assessments who began a term of office on or after December 1, 2026, beginning December 1, 2029 shall be paid a salary in an amount equal to 80% of the amount paid to the State's Attorney of the county that employs the elected or appointed supervisor of assessments. Amends the Counties Code and the Clerks of Courts Act. Provides that, beginning December 1, 2026, the compensation of a coroner, a county treasurer, a county clerk, a recorder, an auditor, or a clerk of a circuit court shall be equal to 80% of the amount paid to the State's Attorney of the coroner's, county treasurer's, county clerk's, recorder's, or auditor' s county. Provides that, the State must pay 66 2/3% of each officer's annual salary. Provides that, beginning with fiscal year ending on June 30, 2027, the county clerk, recorder, auditor, coroner, and treasurer of each county, and the chief clerk of each county board of election commissioners, shall receive a stipend in the amount of $12,800, adjusted annually.

SOCIAL MEDIA-REPORT FRAUD

Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a social media company shall make available to account holders a 24-hour toll-free telephone number through which an account holder may contact a live customer service representative of the social media company to report fraudulent activity on an account holder's social media account, including, but not limited to, unauthorized access. Provides that a social media company shall include the telephone number and an explanation of the purpose of the telephone number in any email notification concerning account security sent to an account holder and post the telephone number and explanation in a prominent location on the homepage or help page of the social media platform. Provides that a violation of the provision constitutes an unlawful practice within the meaning of the Act.

BODY CAMERAS-AUXILIARY OFFICER

Amends the Law Enforcement Officer-Worn Body Camera Act. Provides that an auxiliary officer is a law enforcement officer for purposes of the Act. Amends the Law Enforcement Camera Grant Act. Specifies that the Illinois Law Enforcement Training Standards Board must make grants to units of local government in Illinois and Illinois public universities for, among other things, purchasing or leasing officer-worn body cameras and associated technology for auxiliary officers and training auxiliary officers. Defines "auxiliary officer" for purposes of both Acts.

CO-RESPONDER UNIT-MCHENRY CNTY

Amends the Co-Responder Pilot Program Division of the Illinois Municipal Code. Adds the McHenry County Sheriff's Office to the offices to which the Division is applicable and requires the Office to establish a co-responder unit no later than 6 months after the effective date of the amendatory Act and hire specified personnel. Makes conforming changes, including in the Counties Code. Provides that, along with the duties described elsewhere in the Division, the unit's social workers are responsible for following up with victims (rather than conducting follow-up visits for victims) who may benefit from mental or behavioral health services.

PRIVACY CRIM JUSTICE DATA

Creates the Privacy of Criminal Justice Data Act. Provides that each contractor or business that stores, maintains, or purchases criminal justice data for and from a State agency or unit of local government shall certify in the contract, under penalty of perjury, that the contractor or business will not share that data with U.S. Immigration and Customs Enforcement or for civil immigration enforcement purposes. Creates the Criminal Justice Information Sharing Act. Provides that every contract with the State or a unit of local government to store, maintain, or purchase criminal justice information of this State or a unit of local government shall contain a provision in which the contractor certifies that it shall not share the criminal justice information with Immigration and Customs Enforcement (ICE) or for civil immigration enforcement purposes. Defines terms.
