$IDOT-ROAD FUND REAPPROP

Appropriates $1,260,000,000 to the Department of Transportation to be used for transportation related purposes in municipalities, counties, townships and road districts for projects related to (1) State and local asset management, (2) ADA improvements, (3) bike and pedestrian infrastructure improvements, (4) multi-modal connections, (5) capital safety improvement, and (6) match for federal grant opportunities. Effective July 1, 2026.

BUSINESS-TECH

Creates the Artificial Intelligence Companion Model Safety Act. Provides that an operator shall not make available or deploy an artificial intelligence companion unless the artificial intelligence companion maintains and implements a protocol to detect and address suicidal ideation or expressions of self-harm by a user to the artificial intelligence companion. Requires an operator to provide a clear and conspicuous notification to a user, either verbally or in writing, in the language that the user is interacting with the artificial intelligence companion, that the user is communicating with an automated system and not with a human. Provides that an operator shall, for a user that the operator determines to be a minor, or if the operator's artificial intelligence companion is directed to minors, implement reasonable measures to prevent its artificial intelligence companion from generating or producing material that is harmful to minors or directly stating that the minor should engage in conduct that is harmful to minors. Provides that a violation of specified provisions constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Specifies that the remedies provided in the Act are cumulative and do not preclude any other lawful civil, administrative, or criminal remedy available under State or federal law, including, but not limited to, product liability actions. Amends the State Finance Act, the Wellness and Oversight for Psychological Resources Act, and the Consumer Fraud and Deceptive Business Practices Act to make conforming changes. Effective January 1, 2027.

REPEAL-ENERGY ACT

Restores the statutes to the form in which they existed before their amendment by Public Act 102-662. Repeals the Energy Transition Act, the Energy Community Reinvestment Act, the Community Energy, Climate, and Jobs Planning Act, and the Illinois Clean Energy Jobs and Justice Fund Act. Effective immediately.

EPA-GHG-EMITTING-GAS-DEADLINES

Amends the Environmental Protection Act. In provisions regarding greenhouse gases, deletes provisions requiring electric generating units and large greenhouse gas-emitting units that use gas as a fuel or that use cogeneration technology to permanently reduce all COe and copollutant emissions to zero by certain dates and makes conforming changes.

HOME UTILITY RELIEF ACT

Creates the Home Utility Relief Act. Requires the Department of Commerce and Economic Opportunity to create, as soon as practicable, a Home Utility Rebate Program to provide rebates to households that use electricity and that have a median household income between 100% and 500% of the poverty guidelines updated periodically in the Federal Register by the U.S. Department of Health and Human Services. Provides that eligible households shall receive the rebates as soon as practicable after implementation of the program. Requires the Department to, by rule, establish qualifications for program participation which may include requirements that apply under the Energy Assistance Act and other requirements. Provides that rebates provided under the program shall be funded through appropriations made from the Home Utility Rebate Relief Fund created under the Act. Requires the State Comptroller to direct and the State Treasurer to transfer $500,000,000 from the General Revenue Fund to the Home Utility Rebate Relief Fund to provide rebates to qualifying households for State fiscal years 2026 and 2027. Provides that any funds left over at the end of the second month following the conclusion of payments to households in a fiscal year may be awarded to certain qualifying first-time small business owners as determined by the Department. Requires the Department to adopt emergency rules in accordance with the Illinois Administrative Procedure Act to implement the program. Amends the State Finance Act to include the Home Utility Rebate Relief Fund as a special fund. Effective immediately.

DAVE SANDERS WAY

Designates the portion of Southwest Highway between 12600 and 13100 in Palos Park as "Dave Sanders Way".

RELEASE-FIREARM OFFENSES

Amends the Code of Criminal Procedure of 1963. Provides that notwithstanding any other provision of the Code to the contrary, the denial of pretrial release is required if the person is a felon who is charged with a firearm offense.

CONGRATS-SWALCO

Congratulates the Solid Waste Agency of Lake County (SWALCO) on the historic occasion of its 35th anniversary. Commends its leadership, members, and staff for their exceptional contributions to environmental stewardship. Extends sincerest best wishes for their continued success.

CONGRATS-GRAND PRAIRIE FRIENDS

Congratulates Grand Prairie Friends on the 50th anniversary of Prospect Cemetery Prairie Nature Preserve. Commends its ongoing commitment to conservation, education, and stewardship.

INC TX-DEDUCTION FOR TIPS

Amends the Illinois Income Tax Act. Creates an income tax deduction for gratuities that are included in the taxpayer's federal adjusted gross income. Effective immediately.

EDUCATION PROPERTY TAX RELIEF

Amends the Budget Stabilization Act. Provides additional scheduled transfers to the Pension Stabilization Fund, sets termination conditions, and clarifies allocation and applicability of payments. Amends the School Code. Establishes a property tax relief grant program for school districts beginning in Fiscal Year 2030, funded from the Education Property Tax Relief Fund. Makes conforming changes in the State Finance Act.

BODY CAMERAS-FOIA REQUESTS

Deletes changes to the Law Enforcement Officer-Worn Body Camera Act and the Criminal Code of 2012. Amends the Freedom of Information Act. Provides that a public body may charge fees reflecting its actual costs up to $40 for each hour spent by personnel in searching for and retrieving a requested recording or examining the record for or applying necessary redactions on requests for recordings that are made pursuant to the Law Enforcement Officer-Worn Body Camera Act, unless the request is made by: (1) a court order; (2) the subject of the encounter or the subject's legal representative; (3) a witness to the encounter or the witness's representative, if the encounter resulted in the recording being flagged; (4) a representative of the news media, as defined in the Act; or (5) a nonprofit, scientific, or academic organization when the principal purpose of the request is (i) to access and disseminate information concerning news and current or passing events, (ii) for articles of opinion or features of interest to the public, or (iii) for the purpose of academic, scientific, or public research or education. Provides that a public body shall respond to requests for recordings within 5 business days after the receipt of the request with an estimated time that will be required for the public body to provide the recordings requested and an estimate of the fees to be charged. Further provides that the public body shall have an additional 5 business days to respond to a request once payment of the estimated fee is made, as well as any extensions allowed under any other applicable provisions of the Act. Specifies that if the requester fails to pay the required estimated fees within 30 days after the public body requests payment of the estimated fee, then the public body may deny the request. Requires a public body that imposes a fee under the provisions of the amendatory Act must provide the requester with an accounting of all fees, costs, and personnel hours in connection with the request for public records and must apply a new balance or refund based on the actual cost versus the paid estimate. Authorizes a waiver of fees under the amendatory Act if the requester can demonstrate that the purpose of the request is to access and disseminate information in order to further the interest of the health, safety, and welfare or the legal rights of the community.

PROHIBITED FOOD ADDITIVES

Amends the Illinois Food, Drug and Cosmetic Act. Provides that, beginning January 1, 2027, a person or entity shall not manufacture a food product for human consumption that contains brominated vegetable oil, potassium bromate, propylparaben, or red dye 3. Provides that, beginning January 1, 2028, a person or entity shall not sell, deliver, distribute, hold, or offer for sale a food product for human consumption that contains any of those substances. Provides that a person or entity that violates the prohibition shall be liable for a civil penalty not to exceed $5,000 for a first violation and not to exceed $10,000 for each subsequent violation, with enforcement by the Attorney General or a State's Attorney. Makes a conforming change.

CONTROLLED SUB-FENTANYL

Amends the Illinois Controlled Substances Act. Makes structural and other changes to the list of controlled substances. Adds xylazine as a Class III controlled substance. Defines "isomer". Effective January 1, 2026.

MEDICAID-SICKLE CELL DISEASE

Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides medical assistance coverage for sickle cell disease (rather than sickle cell anemia).

DISPOSABLE FOOD CONTAINER ACT

Creates the Disposable Food Service Container Act. Provides that, beginning January 1, 2030, a person may not sell or distribute in this State a disposable food service container that is composed in whole or in part of polystyrene foam. Specifies that the prohibition does not apply to any activity authorized under an ordinance or resolution adopted by a unit of local government on or before January 1, 2024 or with respect to sales made to a unit of local government for use by the unit of local government for its internal operations. Sets forth penalties for violations of the Act. Limits home rule powers. Effective immediately.

STATE COMPTROLLER-STATE FAIR

Amends the Language Equity and Access Act. Makes a technical change in a Section concerning the short title.

MID-ILLINOIS MEDICAL DISTRICT

Creates the Capital City Downtown Medical District Act. Provides that the Capital City Downtown Medical District is created in the City of Springfield to help build and sustain a vibrant and thriving downtown zone in the State's capital city by encouraging economic development, by increasing the number of people who reside, who are employed, who visit, and who study within the District, and by increasing the economic activity in the heart of downtown Springfield through commercial development, including mixed-use housing development, workforce housing, student housing, and middle-income housing within walking distance of government, healthcare, commercial, and educational facilities in and near the District. Provides that the Capital City Downtown Medical District Commission is created. Allows for rulemaking necessary to enforce the provisions of the Act by the Capital City Downtown Medical District Commission. Makes other conforming changes. Repeals the Mid-Illinois Medical District Act. Amends the State Finance Act and the Eminent Domain Act. Removes provisions concerning the Mid-Illinois Medical District Act.

STATE GOVERNMENT-TECH

Creates the Multi-Unit Residential Rental Property Right of First Refusal Act. Creates a statutory right of first refusal for tenants of multi-unit residential rental properties in Illinois providing tenants, who must be organized as a formal association, the opportunity to purchase their building before or concurrent with any third-party sale. Applies to multi-unit residential rental property that is a residential building or group of residential buildings operated as one entity that contain 6 or more distinct dwelling units available for rent. Creates exceptions to which the Act does not apply, including, but not limited to, multi-unit property that is governed by the Condominium Property Act or the Mobile Home Landlord and Tenant Rights Act. Requires that, before listing a property for sale, an owner must provide a written notice of intent to sell to all tenants at least 90 days in advance by certified mail or personal delivery. Provides that upon receiving either notice, tenants, through a formally incorporated tenants' association, have 90 days to execute a purchase contract matching the owner's bona fide offer of sale. Provides that if the owner later lowers the price by 20% or more, tenants receive an additional 10-day window to match the new price if at least two-thirds of the tenants consent in writing. Provides that if tenants dispute the owner's offer as not being a bona fide offer of sale, they may request an independent appraisal within 30 days in which costs are split one-third by the tenants and two-thirds by the owner. Provides that the appraised value becomes the binding sale price unless both parties agree otherwise or the owner withdraws the offer in which case the owner must reimburse the tenants' share and is barred from re-offering without a third-party contract for 3 months. Provides that if public funds are used in the purchase, the property must be maintained as affordable housing for at least 30 years (rents capped at 60% area median income; new tenant income is capped at 120% area median income). Prohibits a property owner from (1) requiring a preemptive waiver of the right of first refusal as a condition of offering, maintaining, or renewing a lease; (2) demanding a waiver of the right of first refusal under threat of harassment or retaliation; (3) attempting to deny a tenant's ability to exercise the tenant's right of first refusal or assign their rights to a third party; or (4) attempting to deny an authorized third party from exercising the right of first refusal. Provides that any aggrieved tenant or association may bring a civil action and may be awarded treble damages, court costs, and reasonable attorney's fees. Requires the Illinois Housing Development Authority to adopt rules to implement the Act. Makes other changes.
