H.R.8990

Protect Domestic Oil and Gas Small Business Act of 2026

Introduced·5/21/26

Excludes marginal oil and gas wells from certain Clean Air Act standards and enforcement actions.

The Protect Domestic Oil and Gas Small Business Act of 2026 amends the Clean Air Act to exclude marginal wells from specific standards of performance and other requirements. A marginal well is defined as an oil well producing 15 barrels per day or less, or a natural gas well producing 90,000 cubic feet per day or less. The Act also mandates the Environmental Protection Agency to revise regulations within 180 days to implement these changes. Pending enforcement actions related to these standards are terminated, and the EPA cannot require state plans to include standards for marginal wells.
