The CLEAR Act provides relief to retailers and end users in secondary patent infringement actions.

The CLEAR Act, or Customer Legal Ease and Relief Act, aims to protect retailers and end users in secondary patent infringement actions. It allows courts to stay proceedings against retailers or end users if the manufacturer is a party to the action, the retailer or end user does not manufacture the accused instrumentality, and they agree to certain conditions. The court can also require a bond or escrow if there is a likelihood the manufacturer cannot satisfy a damages judgment.
