The fair market rate is based on the time, type of legal services, and comparable costs in the county where the action is heard. The attorney general may refuse to represent a state agency with an outstanding reimbursement balance unless required by the governor or general assembly. The attorney general must notify the governor, president of the senate, and speaker of the house of representatives of any refusal and the reason for it.
