New York S10328 amends the highway law to require that asphaltic concrete used in highway construction contain at least 30% reclaimed asphalt pavement by weight. This requirement applies to all asphaltic concrete except for I-4 mix or other heavy-duty asphaltic concrete mix approved by the commissioner. The commissioner may set higher percentages if necessary. The commissioner may also waive compliance if a sufficient supply of reclaimed asphalt pavement is not available.
