Enacts the "utility fair acquisition act" to reduce the appraised value of infrastructure in acquisitions by municipal or public benefit corporations.
The "utility fair acquisition act" mandates that in any acquisition by a municipal corporation or a public benefit corporation of infrastructure operated by a public utility company or private energy provider, the appraised value shall be reduced by the value of infrastructure financed through customer user fees, ratepayer surcharges, or other non-investor-funded mechanisms. The Public Service Commission determines this value and recommends a commensurate reduction in the acquisition price.
