Permits a plaintiff to recover directly against a third party defendant found liable for contribution or indemnification.
This bill amends the civil practice law and rules to allow a plaintiff to recover directly against a third-party defendant found liable for contribution or indemnification. If a plaintiff has a judgment against a defendant that remains unsatisfied for thirty days, and the defendant has a cause of action for contribution or indemnification against a co-defendant or third-party defendant, the plaintiff can collect the unsatisfied amount from the third-party defendant. This remedy is in addition to any other means available for enforcing the judgment.
