New York S02028 modifies eligibility for ordinary disability benefits for Tier 3 members of the New York City Police Pension Fund.
New York S02028 amends the eligibility criteria for Ordinary Disability Retirement (ODR) benefits for Tier 3 members of the New York City Police Pension Fund. The bill removes the requirement for members to be eligible for primary Social Security disability benefits (SSDI) and having at least five years of credited service. Instead, members determined to be disabled by the Police Medical Board would be eligible for an ODR benefit. The benefit would be equal to the greater of 1/3 of applicable Final Average Salary (FAS) or 2% of applicable FAS multiplied by credited service.
