Enacts the "duty to intervene accountability act" to establish criminal liability for correction officers who fail to intervene to prevent assaults.

The "duty to intervene accountability act" amends the penal law to establish criminal liability for correction officers who fail to intervene to prevent assaults on incarcerated individuals resulting in death or serious physical injury. This act also requires correction officers who witness such assaults to promptly report the incident to a supervisor and the inspector general. Failure to report can result in disciplinary action, including termination, in addition to any criminal liability.
