Allows individuals adversely affected in the OPWDD system to return to prior transitional care placements.

This bill amends the mental hygiene law to allow an adult individual adversely affected in the Office for People With Developmental Disabilities (OPWDD) system to return to their prior transitional care placement at an out-of-state or in-state residential school or adult program, if certain conditions are met. These conditions include the prior placement being willing and able to re-admit the individual, the individual or their guardian consenting, and the OPWDD system failing to provide appropriate services. The bill also revives the individual's administrative due process rights upon return.
