Allows outcry and disclosures in sexual abuse cases to be admissible regardless of timing.
This bill amends the criminal procedure law to allow outcry and disclosures in sexual abuse cases to be admissible in court regardless of when the disclosure was made relative to the abuse. Such evidence may come from the complainant and others who heard or saw any disclosure, and may include multiple disclosures. The court must instruct the jury on the permissible uses of such testimony. The bill does not prohibit defendants from introducing evidence of a complainant's failure to promptly disclose the alleged crime.
