New York S08332, known as the "small cannabis farmer relief act," allows certain licensees who qualify as distressed farmers and who legally cultivated cannabis during 2022 or 2023 to expand their cultivation canopy. Eligible licensees can apply to the office to expand their canopy up to twice the maximum square footage cultivated in 2022 or 2023. No additional fees will be assessed for these canopy expansions. The expanded area must comply with all applicable environmental, security, and testing regulations. This act takes effect immediately and will expire on December 31, 2028.
