New York S08086 amends the mental hygiene law to allow courts to award a reasonable compensation to court evaluators, including the mental hygiene legal service, in guardianship matters. Compensation is payable by any or all of the petitioner, the alleged incapacitated person, or the estate of the deceased. The compensation is awarded when a judgment grants a petition, denies or dismisses a petition, or if the alleged incapacitated person dies before a determination is made. The court determines the proportions of the compensation.
