Permits the detention of juveniles with adults when no other facility is available within fifty miles.
This bill amends the criminal procedure law and the family court act to allow the detention of juveniles with adults when no other facility is available within fifty miles. It grants right of first refusal to detention facilities authorized by the office of children and family services. If no facilities are available within a reasonable distance, the court may direct the juvenile to be lodged in an adult facility until a suitable juvenile facility is available. The act takes effect immediately.
