The Low Impact Landscaping Rights Act prevents homeowners' associations from adopting or enforcing rules that would prohibit or unreasonably limit the installation or maintenance of low impact landscaping. Low impact landscaping includes pollinator gardens, rain gardens, habitat gardens, and natural gardening using native plants. Homeowners' associations may still restrict low impact landscaping on common property, if it is not maintained, or if it poses safety risks or encroaches on common or neighboring spaces. Denials of installation requests must be detailed in writing.
