New York's penal law is amended to establish three degrees of phishing offenses. Phishing in the third degree is a class A misdemeanor for sending emails urging individuals to send money, download malware, or input personal information. Phishing in the second degree is a class E felony for causing over $500 in monetary loss or damage. Phishing in the first degree is a class D felony for causing over $2,000 in monetary loss or damage. Prosecution for these offenses must be commenced within twenty years of the commission.
