Establishes the crime of harassment of an employee by an incarcerated individual as a class B misdemeanor.
New York S04890 amends the penal law to establish the crime of harassment of an employee by an incarcerated individual. This crime occurs when an incarcerated individual intentionally engages in conduct that would cause an employee to be in clear view of the individual while displaying or touching their intimate parts, or communicates to an employee that they will cause the employee to come in contact with the individual's bodily fluids. The bill makes this a class B misdemeanor. The amendments do not affect the expiration of existing provisions and will expire with them.
