This bill amends the general obligations law to require trustees and beneficiaries to make a good faith effort to identify and notify co-trustees and co-beneficiaries when signing a power of attorney. Trustees must notify co-trustees of the signing and identify the agent if the agent is not a co-trustee. Beneficiaries must notify co-beneficiaries of the signing and identify the agent if the agent is not a co-beneficiary. If co-beneficiaries cannot be identified or contacted, the principal must attest to the efforts made.
