New York S00829 amends the penal law and vehicle and traffic law to establish the crimes of vehicular assault and vehicular manslaughter in an active work zone. Vehicular assault in an active work zone in the second degree is a class E felony, while in the first degree it is a class D felony. Vehicular manslaughter in an active work zone in the second degree is a class C felony, and in the first degree it is a class B felony.
