New York S00596 amends the executive law to provide a rebuttable presumption for recertification of minority and women-owned business enterprises (MWBE). If there is no change in the ownership of the enterprise and no material change in the nature or management of the enterprise from the time of approval of the previous MWBE certification, the previous certification satisfies the requirements for recertification. This applies to applications submitted on and after the effective date of the act.
