The "avoiding vexatious overuse of impleading to delay (AVOID) act" amends the civil practice law and rules to establish specific time frames for filing third-party summons and complaints. A defendant must file such a complaint within sixty days after serving an answer. A third-party defendant who files their own complaint must do so within twenty days after serving an answer. Subsequent third-party defendants must file within forty-five and thirty days respectively. The act prohibits filing after a note of issue is filed and disallows consolidation of severed third-party actions.
