New York bill A08189 amends the workers' compensation law to clarify that workers who are temporarily partially disabled are entitled to benefits at a reduced rate. This benefit is payable during the continuance of the disability, unless the worker's separation from employment is unrelated to the compensable injury. The compensation is calculated as two-thirds of the difference between the worker's average weekly wages before the accident and their wage earning capacity after the accident. The act takes effect immediately.
