New York A07413 amends the public health law and the surrogate's court procedure act to conform and improve the process for determining incapacity. It requires that the initial determination of a patient's lack of capacity be subject to a concurring determination by a health or social services practitioner. Hospitals must adopt written policies identifying the training and credentials of practitioners qualified to provide concurring determinations of incapacity.
