When a defendant is charged with a felony, the court must request a risk and needs assessment from the county pre-trial services agency. This assessment helps determine whether the defendant should be released on their own recognizance, released under non-monetary conditions, or, where authorized, bail or commit the defendant to the custody of the sheriff. The assessment is not the sole factor in this determination.
