New York A06351 amends the social services law to create incentives for counties to investigate and prosecute medicaid fraud. If a county or the city of New York successfully prosecutes a case for medicaid fraud and a court awards restitution or civil forfeiture, the county or city will receive a portion of the non-federal share of the proceeds. Specifically, the county or city will receive 100% of the local share of such funds, or 10% of the total recovery, whichever is greater. The remainder of the funds will be deposited into the general fund of the state.
