New York A05388 prohibits deceptive gratuity solicitations in businesses.
New York A05388 amends the general business law to prohibit deceptive gratuity solicitations. A gratuity is considered solicited in a deceptive manner if it lacks corresponding dollar or percentage amounts, is calculated from the total amount owed including taxes or fees, or is presented in a manner proscribed by the attorney general. Establishments must not solicit gratuities deceptively and must bring non-compliant point-of-sale terminals into compliance. Manufacturers and software providers must ensure new terminals do not include deceptive functions.
