New York A05026 amends the real property law to mandate that sellers provide a certificate of occupancy to purchasers before executing a deed of sale. This requirement does not apply to transfers to relatives, court-ordered transfers, transfers by municipalities, transfers by estate executors or administrators, transfers by estate beneficiaries within 60 days of acquiring title, or transfers by deed in lieu of foreclosure. Any agreement waiving these rights is void as against public policy. The act takes effect 120 days after becoming law.
