This bill amends the social services law to prohibit medical assistance providers from refusing to furnish care, services, or supplies to individuals entitled to Medicaid benefits if the provider also furnishes the same care under Medicare and the individual is dually eligible. The bill defines "medical assistance provider" and mandates the commissioner of health to make necessary amendments to the state plan for medical assistance or apply for any waiver or approval under the federal Social Security Act. The act will take effect 180 days after it becomes law.
