New York A04775 amends the penal law by adding a new section that establishes the class B felony of criminal sale of a controlled substance upon the grounds of a drug or alcohol treatment center. This includes areas within the real property boundary of such facilities, any methadone clinic, or within one thousand feet of the boundary. A rebuttable presumption of knowledge is established if notice of the facility's presence is conspicuously posted. The act will take effect on November 1 following its enactment.
