Authorizes a court to order the division of criminal justice services to compare fingerprints of the defendant against the statewide database.
This bill amends the criminal procedure law to allow a court to order the division of criminal justice services to compare a defendant's fingerprint against the statewide automated fingerprint identification system. The court can make this order in response to a motion, provided the fingerprint meets federal or state requirements and there is a reasonable probability that the verdict would have been more favorable to the defendant if the results had been available before the plea. The act takes effect immediately.
