New York A03403, known as "Ildefonso Romero's law," amends the penal law to establish the felony offense of aggravated assault. This offense occurs when a person causes serious physical injury or death to another person or a third person with intent to cause physical injury, recklessly causes such injury or death, or causes such injury or death with criminal negligence using a deadly weapon or dangerous instrument. Aggravated assault is classified as a class E felony. The act will take effect on November 1 following its enactment.
