Assaulting an employee of New York state or its political subdivisions or public authorities is assault in the second degree.
New York Assembly Bill A03282 amends the penal law to establish that a person is guilty of assault in the second degree if they intend to cause physical injury to an employee of New York state or any of its political subdivisions or of a public authority or a public benefit corporation while such employee is performing their duties. The bill adds a new subdivision to section 120.05 of the penal law, effective immediately.
