New York A01642 amends the Emergency Tenant Protection Act to allow for the determination of legal regulated base date rent at the four-year lookback using either the survey sampling method or the default method if there is fraud. This bill also specifies that for complaints filed within ninety days of the initial registration of a housing accommodation, the legal regulated rent for determining an overcharge shall be the rent charged six years prior to the initial registration. If the rent charged six years prior cannot be established, the rent shall be established by the division.
