New York A00937 prohibits insurers from limiting payments on motor vehicle damage claims based on pricing caps and from recommending specific repair.
New York A00937 amends the insurance law to ensure insurers cannot limit payments on motor vehicle damage claims based on pricing caps for labor, parts, paint, or repair materials. All elements of such claims must be negotiated with the insured or their representative, by a licensed appraiser. Additionally, insurers are prohibited from recommending a specific repair facility. If an insurer does recommend a facility and the claimant accepts, the insurer must restore the vehicle to its pre-loss condition at no additional cost to the claimant, other than policy deductions.
