New York A00301 amends the penal law to establish the crime of fertility fraud. A health care provider commits this crime if they knowingly or intentionally perform an assisted reproduction procedure using their own spermatozoon or ovum, or using human reproductive material without the donor's consent. This includes using material from a donor other than one from whom the patient has consented in writing. The bill defines human reproductive material as a human spermatozoon or ovum, or a human organism from a fertilized ovum to an embryo. Fertility fraud is classified as a class E felony.
