The Farewell to Foam Act of 2025 prohibits the sale and distribution of expanded polystyrene food service ware, expanded polystyrene loose fill, and expanded polystyrene coolers. Effective January 1, 2028, food service providers, manufacturers, distributors, and retailers cannot sell, offer for sale, or distribute these items. The Environmental Protection Agency Administrator must notify violators and impose civil penalties for subsequent violations. The act also allows states to enforce these provisions if they meet certain criteria.
