Amends Fair Labor Standards Act to include restricted stock units in employer equity exemption.
The Valuing Employee Stock Today Act, or VEST Act, amends the Fair Labor Standards Act of 1938 to clarify that restricted stock units qualify for the exemption from regular rate determinations. This exemption applies to employer-provided grants or rights under stock option, stock appreciation right, or restricted stock unit programs. The changes take effect 90 days after the enactment of this Act. Employers will not be liable for failing to include income or value derived from restricted stock units in an employee’s regular rate if the grants or rights were obtained before the effective date.
