Responsibility in Drug Advertising Act of 2025 restricts direct-to-consumer drug advertising.
The Responsibility in Drug Advertising Act of 2025 amends the Federal Food, Drug, and Cosmetic Act to restrict direct-to-consumer drug advertising. It prohibits advertising of drugs approved under section 505(c) for the first three years after approval unless the Secretary of Health and Human Services grants a waiver based on public health value. After the three-year period, the Secretary may prohibit advertising if the drug has significant adverse health effects. The Secretary must revise regulations within one year to implement these changes.
