The PBM Act, or Patients Before Monopolies Act, seeks to address the concentration of market power in the pharmacy benefit manager industry. It prohibits entities from owning both a pharmacy benefit manager and a pharmacy to prevent conflicts of interest that may lead to higher prescription drug costs and reduced competition. The Act mandates divestiture of pharmacies by entities in violation within one year of enactment. It also empowers the Federal Trade Commission and the Department of Justice to enforce the Act, including blocking transactions that would re-create conflicts of interest.
